The guaranties of the employed person holding civil law employment contracts to occupational<br />
health & safety according to the legislation are determined by these contracts.<br />
The guaranties of other categories of employed person’s right to occupational health & safety are<br />
determined by the legislation.<br />
Chapter 4 - Occupational health & safety organization<br />
Article 13 . Responsibilities of employer in occupational health & safety<br />
Employer shall be required to:<br />
o ensure safe operation and maintenance of the territories, industrial buildings (premises),<br />
structures, equipment/ technological processes and applied materials, chemical substances<br />
as well as effective using of equipment and means of collective and personal protection.<br />
o whenever two or more employers are exploiting the territory, industrial buildings (premises),<br />
structures or equipment then the responsibilities for ensuring observance of occupational<br />
health & safety requirements are fulfilled jointly on the basis of written agreement;<br />
o ensure if needed that the workplaces are meeting occupational health & safety requirements<br />
when performing works (render services) and creating intellectual property in compliance<br />
with the civil law employments contracts;<br />
o take measures for preventing accidental hazardous situations and preserving life and health<br />
of the employed persons when such situations occur, render first medical aid when<br />
accidents occur and transfer the injured persons to medical care institutions;<br />
o train employed persons, instruct them, retrain, organize practical work experience, upgrade<br />
qualification and in the order established by the Government of Belarus or by its authorized<br />
body exercise assessment of the employed persons knowledge with respect of their<br />
knowledge of occupational health and safety requirements and regulations;<br />
o keep employed persons informed on working conditions and occupational health & safety<br />
status at workplace, on existing hazard risk of health damage, on personal protective<br />
equipment as well as on compensations and recessions that are due to them with respect to<br />
working conditions;<br />
o investigate and register, in the order established by the legislation, the incidents at work,<br />
occupational diseases, accidents as well as develop and realize preventive measures<br />
o perform compulsory insurance against incidents at work and occupational diseases in<br />
compliance with the legislation;<br />
