F<strong>in</strong>d<strong>in</strong>gs and Recommendations: Mongolian Media (MEDIA)<br />

F<strong>in</strong>d<strong>in</strong>g MEDIA 1. The current licens<strong>in</strong>g regulations enable political distortions by requir<strong>in</strong>g a letter of<br />

support from the local governor; fail<strong>in</strong>g to promote public <strong>in</strong>terest broadcast<strong>in</strong>g by disregard<strong>in</strong>g content;<br />

and underm<strong>in</strong><strong>in</strong>g the capacity of broadcasters by licens<strong>in</strong>g more than the market can currently support.<br />

Recommendation: The GoM <strong>in</strong> consultation with media-related CSOs should 1) remove the licens<strong>in</strong>g<br />

requirement of a governor’s signature from the law on Radio Waves; 2) regulate licens<strong>in</strong>g by consider<strong>in</strong>g<br />

diversity of content and ownership, <strong>in</strong>clud<strong>in</strong>g nonprofit and community broadcasters; and 3) reduce the<br />

number of television licenses to reflect the capacity of the market.<br />

F<strong>in</strong>d<strong>in</strong>g MEDIA 2. The full potential of the national public broadcaster (PRTV) to produce public<br />

<strong>in</strong>terest programm<strong>in</strong>g is threatened by dramatic reductions <strong>in</strong> its sources of fund<strong>in</strong>g and the politicization<br />

of its new govern<strong>in</strong>g body, the National Council.<br />

Recommendations:<br />

1) In collaboration with the PRTV and media-related CSOs, the GoM should promote the capacity<br />

build<strong>in</strong>g of the PRTV to ensure more efficient management and resource mobilization.<br />

International donors should provide <strong>in</strong>itial support <strong>for</strong> such a program, which should <strong>in</strong>clude<br />

<strong>in</strong>vestigation of cost-sav<strong>in</strong>g measures with<strong>in</strong> broadcast<strong>in</strong>g operations and exchanges with other<br />

public broadcasters who have been <strong>for</strong>ced to cut back on operations (<strong>for</strong> example, the Georgian<br />

public broadcaster).<br />

2) PRTV should monitor the impact of elim<strong>in</strong>at<strong>in</strong>g access to advertis<strong>in</strong>g resources, keep<strong>in</strong>g the GoM<br />

and the public <strong>in</strong><strong>for</strong>med about adverse consequences. Should this seriously underm<strong>in</strong>e the ability<br />

of PRTV to provide public <strong>in</strong>terest programm<strong>in</strong>g, public officials should amend this restriction<br />

and establish a five-year budget to promote the autonomy of the PRTV.<br />

3) With <strong>in</strong>itial technical and f<strong>in</strong>ancial support from the <strong>in</strong>ternational community, media-related<br />

CSOs should monitor the implementation of the Public Broadcast<strong>in</strong>g Law and <strong>in</strong>itiate <strong>in</strong>quiries<br />

with the agencies or the judiciary should any shortcom<strong>in</strong>gs be identified.<br />

4) The <strong>in</strong>ternational community should provide technical assistance <strong>for</strong> the capacity build<strong>in</strong>g of<br />

National Council members to enable them to operate effectively and <strong>in</strong> accordance with best<br />

practices around the world.<br />

F<strong>in</strong>d<strong>in</strong>g MEDIA 3. The registration system <strong>for</strong> the media threatens its <strong>in</strong>dependence by permitt<strong>in</strong>g<br />

politicization that causes delays or obstructions <strong>for</strong> those wish<strong>in</strong>g to enter the market.<br />

Recommendation: In consultation with the media and media-related CSOs, public officials should revise<br />

the registration system <strong>for</strong> the media to ensure it does not pose obstacles to potential entrants. They may<br />

transfer this responsibility to a nongovernmental agency to avoid undue political <strong>in</strong>fluence <strong>in</strong> the<br />

registration process. International donor agencies, INGOs, and <strong>in</strong>terested CSOs should actively advocate<br />

<strong>for</strong> these changes by, <strong>for</strong> example, provid<strong>in</strong>g comparative materials on other countries’ experiences.<br />

F<strong>in</strong>d<strong>in</strong>g MEDIA 4. Although a Draft Law of Mongolia on Freedom of In<strong>for</strong>mation was prepared <strong>in</strong><br />

2002, parliament has not passed legislation to ensure access to <strong>in</strong><strong>for</strong>mation required by the media.<br />

Recommendation: Public officials should take immediate action to adopt an access to <strong>in</strong><strong>for</strong>mation law<br />

that is <strong>in</strong> l<strong>in</strong>e with constitutional and <strong>in</strong>ternational standards. In collaboration with CSOs and the media,<br />

and with <strong>in</strong>itial fund<strong>in</strong>g from the donor community, the GoM should then promote its implementation<br />

through tra<strong>in</strong><strong>in</strong>g and publicity.<br />

F<strong>in</strong>d<strong>in</strong>g MEDIA 5. A culture of secrecy, re<strong>in</strong><strong>for</strong>ced by several broad secrecy laws, is <strong>in</strong>consistent with<br />

open government and obstructs the media’s access to <strong>in</strong><strong>for</strong>mation.<br />
