3) CSOs should be a primary means <strong>for</strong> dissem<strong>in</strong>at<strong>in</strong>g <strong>in</strong><strong>for</strong>mation about pend<strong>in</strong>g bills and recent<br />
legislation to an <strong>in</strong><strong>for</strong>med public and should be encouraged to assist <strong>in</strong> dissem<strong>in</strong>at<strong>in</strong>g this<br />
<strong>in</strong><strong>for</strong>mation to the broader public.<br />
4) The media, <strong>in</strong> particular public broadcasters, should produce public <strong>in</strong>terest programs about<br />
pend<strong>in</strong>g issues, proceed<strong>in</strong>gs, and key decisions by public bodies.<br />
F<strong>in</strong>d<strong>in</strong>g 3.3.3. Public officials deny or delay access to <strong>in</strong><strong>for</strong>mation, whereas the absence of a<br />
comprehensive Access to In<strong>for</strong>mation Law underm<strong>in</strong>es the ability of civil society to exercise its<br />
constitutional right to access <strong>in</strong><strong>for</strong>mation held by public bodies.<br />
Recommendations:<br />
1) Public officials should enact the comprehensive Access to In<strong>for</strong>mation Law, currently on the<br />
parliamentary agenda. To assist <strong>in</strong> that process, CSOs should cont<strong>in</strong>ue their ef<strong>for</strong>ts to ensure that<br />
the Law meets constitutional and <strong>in</strong>ternational standards. This <strong>in</strong>cludes a general presumption of<br />
openness, clear procedures <strong>for</strong> citizens to access <strong>in</strong><strong>for</strong>mation, and a narrow regime of exceptions<br />
to the right of access.<br />
2) The Law should also provide <strong>for</strong> a right to appeal any refusals or undue delays to an<br />
adm<strong>in</strong>istrative body. This body could be either an exist<strong>in</strong>g body, such as the National Human<br />
Rights Commission, or one specifically created <strong>for</strong> this purpose, such as an In<strong>for</strong>mation<br />
Commissioner. Once operational, a capacity-build<strong>in</strong>g program should be established so that this<br />
body is able to fulfill its responsibilities under the Law. Any further appeals should be assigned to<br />
the courts.<br />
3) After the law is adopted, stakeholders should ensure that it is implemented effectively. CSOs<br />
should make active use of the law through comprehensive tra<strong>in</strong><strong>in</strong>g and <strong>in</strong>creased <strong>in</strong>centives <strong>for</strong><br />
public officials to act efficiently <strong>in</strong> provid<strong>in</strong>g the public access to <strong>in</strong><strong>for</strong>mation, publicity to ensure<br />
the public is aware of its right to <strong>in</strong><strong>for</strong>mation, and tra<strong>in</strong><strong>in</strong>g <strong>for</strong> judges to ensure effective<br />
implementation of the legislation.<br />
F<strong>in</strong>d<strong>in</strong>g 3.3.4. CSOs are provid<strong>in</strong>g critical alternative <strong>in</strong><strong>for</strong>mation through the conduct of <strong>in</strong>dependent<br />
research or the creation of <strong>for</strong>ums, <strong>in</strong>clud<strong>in</strong>g newspapers, that confirms, counters, or expands upon the<br />
<strong>in</strong><strong>for</strong>mation provided by the GOM.<br />
Recommendations:<br />
1) With <strong>in</strong>itial technical and f<strong>in</strong>ancial support from the <strong>in</strong>ternational community, CSOs should<br />
expand their provision of alternative sources of <strong>in</strong><strong>for</strong>mation to fill <strong>in</strong> gaps and to confirm the<br />
accuracy of official <strong>in</strong><strong>for</strong>mation. Collaboration among CSOs work<strong>in</strong>g <strong>in</strong> similar or overlapp<strong>in</strong>g<br />
areas may promote efficiency and cost-effectiveness.<br />
2) Given the costs of research, CSOs should collaborate with the GoM and other <strong>in</strong>ternational actors<br />
who are analyz<strong>in</strong>g related issues. Donors should provide start-up fund<strong>in</strong>g <strong>for</strong> data collection and<br />
analysis <strong>in</strong> policy areas critical to governance and development.<br />
3.4 SOCIAL ACCOUNTABILITY THROUGH NEGOTIATION<br />
Citizens’ participation <strong>in</strong> governance beyond the electoral process enhances the effectiveness of<br />
