figure 3.4.3 <strong>in</strong>dicates, citizen participation <strong>in</strong> a public <strong>for</strong>um was highest <strong>for</strong> legislative hear<strong>in</strong>gs.<br />

Moreover, half of the respondents found these hear<strong>in</strong>gs to be at least somewhat effective, <strong>in</strong>dicat<strong>in</strong>g the<br />

highest level of confidence <strong>in</strong> this <strong>for</strong>m of negotiation to <strong>in</strong>fluence public policy (annex 6, Question LL).<br />

Still, there are no <strong>for</strong>mal mechanisms <strong>for</strong> CSO participation <strong>in</strong> the draft<strong>in</strong>g of legislation (F<strong>in</strong>d<strong>in</strong>g 3.4.3).<br />

Various NGOs have been <strong>in</strong>vited to participate <strong>in</strong> targeted work<strong>in</strong>g groups that provide citizen <strong>in</strong>put <strong>in</strong>to<br />

certa<strong>in</strong> draft pieces of legislation. NGOs have also given critical testimony be<strong>for</strong>e parliament and, <strong>in</strong> some<br />

cases, <strong>in</strong>dependently prepared draft legislation, which has been picked up by officials.<br />

Three recent examples on NGO <strong>in</strong>volvement <strong>in</strong>clude the proposed Access to In<strong>for</strong>mation Law; the Public<br />

Service Broadcast<strong>in</strong>g Law, which was passed <strong>in</strong> January 2005; and the Domestic Violence Law, which<br />

was passed <strong>in</strong> 1994, due largely to advocacy ef<strong>for</strong>ts by the National Center Aga<strong>in</strong>st Violence (see annex<br />

1, F<strong>in</strong>d<strong>in</strong>g NCAV 5). The Ongi River Movement also submitted detailed recommendations to <strong>in</strong><strong>for</strong>m<br />

proposed amendments to the 1996 Water Bill at both a National Workshop on the Management of River<br />

Bas<strong>in</strong>s organized by the government and a meet<strong>in</strong>g of the cab<strong>in</strong>et <strong>in</strong> August 2002 (see annex 4). Although<br />

most of their <strong>in</strong>puts did not feature <strong>in</strong> the amended law, the ORM leadership claimed that the new law had<br />

<strong>in</strong> fact reflected a number of the positions they had promoted <strong>in</strong> their recommendations, <strong>in</strong>clud<strong>in</strong>g those<br />

related to the functions of the water management committees.<br />

A representative of the Association of Mongolian Elders (AME) also claimed that his organization had<br />

made recommendations over the years on legislation related to welfare, medical <strong>in</strong>surance, family,<br />

retirement, and pension law, add<strong>in</strong>g that AME cooperates closely with the M<strong>in</strong>istry of Labor and Welfare.<br />

The AME is a “legacy <strong>in</strong>stitution” as it was created and received state fund<strong>in</strong>g under the socialist regime.<br />

As such it cont<strong>in</strong>ues to be one of the few CSOs to receive state fund<strong>in</strong>g <strong>in</strong> Mongolia. Undoubtedly, the<br />

<strong>in</strong><strong>for</strong>mal and <strong>for</strong>mal ties that AME enjoys with public officials have been key not only to its cont<strong>in</strong>ued<br />

fund<strong>in</strong>g but also to its presumed <strong>in</strong>fluence <strong>in</strong> the legislative process.<br />

Although there are relatively few CSOs that receive resources from the GoM, newer CSOs rely on<br />

<strong>in</strong><strong>for</strong>mal networks with public officials <strong>for</strong> their advocacy work. In fact, most active CSOs reported<br />

hav<strong>in</strong>g extensive networks and allies among public officials, often on a partisan basis (F<strong>in</strong>d<strong>in</strong>g 3.4.4).<br />

Both the WSP-UV and the NCAV, <strong>for</strong> example, reported that <strong>for</strong>mal and <strong>in</strong><strong>for</strong>mal networks with officials<br />

have been critical to their capacity to voice the dist<strong>in</strong>ct and varied op<strong>in</strong>ions and concerns of Mongolian<br />

civil society (see annexes 1 and 2, F<strong>in</strong>d<strong>in</strong>gs NCAV 4 and WSP 1, respectively).<br />

Nevertheless, CSO ties to government officials and politicians may be a double-edged sword that<br />

underm<strong>in</strong>es CSO political autonomy and capacity to promote social accountability. 51 Politicians may<br />

create organizations to ga<strong>in</strong> access to f<strong>in</strong>ancial resources from <strong>for</strong>eign donors, or manipulate the agenda<br />

of exist<strong>in</strong>g CSOs as their board members or benefactors. In fact, a lead<strong>in</strong>g political party has been<br />

accused of <strong>in</strong>struct<strong>in</strong>g its members to ga<strong>in</strong> control over the grow<strong>in</strong>g number of CSOs to ga<strong>in</strong> access to<br />

their f<strong>in</strong>ancial and social capital.<br />

In contrast, however, the blurred l<strong>in</strong>e between state and societal actors <strong>in</strong>volved <strong>in</strong> the Ongi River<br />

Movement is not the result of local politicians with nefarious <strong>in</strong>tent but an <strong>in</strong>dication of their commitment<br />

to the environmental mission and activities of ORM. When Ongi leaders decided to send a letter to the<br />

prime m<strong>in</strong>ister and members of parliament, however, the presence of local officials <strong>in</strong> the organization<br />
