The Act is administered by the Minister for Planning.<br />

The Act requires that all proposals, activities, and functions which are investigated,<br />

designed, planned, constructed, and operated by councils should be studied during all<br />

stages for their environmental impact on the basis of scale, location and performance.<br />

Catchment Management Act 1989<br />

The objectives of this Act are:<br />

• To coordinate policies, programs and activities as they relate to total<br />

catchment management;<br />

• To achieve active community participation in natural resource<br />

management;<br />

• To identify and rectify natural resource degradation;<br />

• To promote the sustainable use of natural resources; and<br />

• To provide stable and productive soil, high quality water and protective and<br />

productive soil and vegetation cover within each of the State's water<br />

catchments.<br />

The Act is administered by the Minister for Energy, Utilities and Sustainability.<br />

Any works planned and undertaken by this Committee are subject to normal planning<br />

approval. It has no authority over <strong>Council</strong>.<br />

Soil Conservation Act 1938<br />

The objective of the Soil Conservation Act is the conservation of soil resources and farm<br />

water resources and the mitigation of erosion and land degradation.<br />

The Act is administered by the Minister for Energy, Utilities and Sustainability.<br />

Public Health Act 1991<br />

The Public Health Act 1991 consolidates previous Acts relating to Public Health and<br />

provides for the prevention of the spread of disease.<br />

The Act is administered by the Minister for Health.<br />

Under Section 14 of the Act, the Director-General or any authorised officer of the<br />

Department of Health may inspect sewerage works where the Director-General deems it<br />

necessary in the interest of public health. The Director-General may report to the Minister<br />

for Energy, Utilities and Sustainability whenever any danger to public health could be<br />

removed or diminished. The Minister may then take appropriate action.<br />

Public Works Act 1912<br />

This Act provides the authority for the Department of Energy, Utilities and Sustainability to<br />

construct water supply and sewerage works within the <strong>Council</strong>’s area.<br />

The powers of the Minister for Public Works, particularly with respect to acquisition of land<br />

for water and sewerage works have been transferred to the Minister for Energy, Utilities<br />

and Sustainability.<br />
