Water Management Act 2000<br />

Replaces the previous Water Act 1912, Water Authorities Act 1987 and 10 other Acts<br />

(including irrigation, rivers and foreshore acts).<br />

This Act, administered by the Minister for Energy, Utilities and Sustainability, covers<br />

matters such as water rights licences, water allocation, water sharing as well as<br />

recognition of water for environmental health requirements.<br />

Details have been set out in “Developer Charges Guidelines for Water Supply, Sewerage<br />

and Stormwater” pursuant to section 306 (3) of the Water Management Act 2000. <strong>Council</strong><br />

should consider these guidelines previously issued by the Minister for Land and Water<br />

Conservation, who is now the Minister of Energy, Utilities and Sustainability.<br />

Independent Pricing and Regulatory Tribunal Act 1992<br />

The Independent Pricing and Regulatory Tribunal (IPART, previously <strong>Government</strong> Pricing<br />

Tribunal) was set up to determine and advise prices and pricing policies for government<br />

monopoly services.<br />

The Tribunal currently has powers to set prices for Sydney Water, Hunter Water and<br />

Gosford and Wyong <strong>Council</strong>s. This includes service usage charges and developer<br />

contributions.<br />

The Tribunal does not intend, in the near term, to regulate prices for water supply and<br />

sewerage services in country <strong>NSW</strong>. Instead it has recently released Pricing Principles for<br />

Local Water Authorities which sets out pricing recommendations for <strong>Council</strong>’s to adopt in<br />

the pricing of their services.<br />

Occupational Health and Safety Act 2000<br />

This revised Act details <strong>Council</strong>'s responsibilities to ensure health, safety and welfare of<br />

employees and others at places of work. All of the scheme's operational activities are<br />

impacted on by this Act. This act is administered by the WorkCover Authority.<br />

Protection of the Environment Operations Act<br />

This Act came into effect in July 1998 and consolidated existing legislation to eradicate<br />

the duplication of powers and overlapping use of resources.<br />

The Act brought together what used to be five separate pieces of legislation:<br />

• Clean Air Act 1961;<br />

• Clean Waters Act 1970;<br />

• Pollution Control Act 1970;<br />

• Noise Control Act 1975; and<br />

• Environmental Offences and Penalties Act 1989.<br />

The legislation also incorporates major regulatory provisions of the Waste Minimisation<br />

and Management Act.<br />
