5. The <strong>Modernists</strong> divide <strong>the</strong> Sunnah into 'Sunnah<br />
Tashree'eah' <strong>and</strong> 'Ghair Tashree'eah.' They consider basic<br />
Aqeedah, Salaat, Zakaat, Hajj <strong>and</strong> o<strong>the</strong>r worships as Sunnah<br />
Tashree'eah. But Ahadeeth that speak about general public affairs<br />
<strong>and</strong> rules <strong>and</strong> regulations are according to <strong>the</strong>m, 'Ghair Tashree'eah'<br />
which does not have to be implemented necessarily. This explains<br />
<strong>the</strong>ir aversion in taking judgment from <strong>the</strong> Sunnah.<br />
Muhammad Abduh said,<br />
“What falls under <strong>the</strong> Sunnah from <strong>the</strong> issues <strong>of</strong><br />
politics are worldly issues <strong>and</strong> not Deen. It was so even<br />
during <strong>the</strong> time <strong>of</strong> <strong>the</strong> Prophet <strong>and</strong> thus it is subject to<br />
shoora (consultation) <strong>and</strong> rai (opinion) <strong>and</strong> ijtihad (<strong>and</strong><br />
<strong>the</strong>refore can be), accepted, rejected, modified <strong>and</strong><br />
made additions to.”<br />
Muhammad Abduh says about <strong>the</strong> prohibition <strong>of</strong> women ruler-ship,<br />
"What we have in our heritage about <strong>the</strong> issue <strong>of</strong> <strong>the</strong><br />
ruler-ship <strong>of</strong> women is an <strong>Islam</strong>ic thought <strong>and</strong> Fiqhi<br />
opinion <strong>and</strong> Fiqhi Ijtihad <strong>and</strong> it is not from Allah…"<br />
About <strong>the</strong> <strong>Hadeeth</strong> <strong>of</strong> Allah's Messenger �,<br />
"No people will ever<br />
prosper who place a woman in authority over <strong>the</strong>m."<br />
Abduh says,<br />
"It is a political prophecy from <strong>the</strong> Messenger about<br />
<strong>the</strong> failure <strong>of</strong> <strong>the</strong> Majoos - <strong>the</strong>y were <strong>the</strong> ones who were<br />
ruled by a woman. It is not a comm<strong>and</strong> <strong>of</strong> prohibition for<br />
<strong>the</strong> leadership <strong>of</strong> women, nei<strong>the</strong>r general nor specific. It<br />
was an exceptional case…"<br />
