Responsibility of Various Entities for FirePrevention and <strong>Safety</strong> FundsAny local school board that wishes to use Fire Prevention and <strong>Safety</strong> funds to finance repairs oralterations to any school building is required to file an amendment to respond to findings of• an annual inspection by the regional superintendent (Chapter 2),• a safety survey report (Chapter 3),• a citation by a government enforcement agency (105 ILCS 5/2-3.12),• a citation by a local fire department or fire protection district (105 ILCS 5/2-3.12),• a district-initiated inspection, or• to correct errors or omissions in a previously approved amendment.The local school board, guided by The Local Government Professional Services Selection ActSection 50 ILCS 510/0.01, is required to hire an Illinois-licensed architect or engineer to assist thedistrict in correcting the violations using the school building code known as "<strong>Health</strong>/<strong>Life</strong> <strong>Safety</strong>Code for Public Schools,” Part 180.Local School Board• submits to the county clerk the following documents: Certificate of Tax Levy, State Certificateof Approval, Order to Effect, and the Regional Superintendent’s Certificate of Approval to levythe tax, if Operations and Maintenance funds or existing Fire Prevention and <strong>Safety</strong>Funds are insufficient.• applies for a building permit at the Regional Office of Education, if required.• authorizes the architect/engineer to proceed with all the necessary documents for biddingpurposes, if subject to the bidding requirements of Section 10-20.21 of the School Code.• oversees that the proposed work is scheduled and completed.• obtains an occupancy permit from the regional superintendent, if a building permit wasrequired.Licensed Design Professional (Architect/Engineer)• inspects buildings for violations, repairs or alterations.• prepares a report of the inspections.• certifies that to the best of his/her knowledge, the recommendations and estimated cost toabate the violations are true and accurate.• certifies that the work was completed as approved.Regional Superintendent• determines the nature and scope of the proposed work.• checks the reasonableness of the estimated cost and the timelines in regard to the completionof the proposed work.• inspects the facility, if necessary, to verify the information provided by the architect/engineer.• forwards the necessary forms to the state superintendent’s office.• concurs with proposed recommendations of the architect/engineer.• issues an order to effect recommendations of the licensed design professional.• ensures that “required” work is scheduled and completed within 5 years, urgent within 1 year.• approves Extension(s) of Time.• Issues Building & Occupancy Permits, as needed.4-2
