Therepatriation guarantee provides that the private servant shall notchange employers and leave the RSA upon severance ofemployment or on completion of the representative’s term of dutyin the Republic. The Department of Home Affairs is informedaccordingly.1.3.14 Upon reciprocity confirmation, the number of private servantsregulated by the Department in terms of the Vienna Conventions onDiplomatic and Consular Relations of 1961 and 1963 respectivelyare as follows:(a)(b)(c)(d)Heads of diplomatic missions: two persons with functionalimmunity;Heads of consular posts: one person without immunity;Transferred representatives at diplomatic missions and consularposts: one person without immunity;Heads of Offices of International Organisations conferred withdiplomatic status specified in the Treaty entered into with theSouth African Government: one person without immunity.Page 16 of 90
DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATION1.3.15 Private servants shall apply for courtesy visas at South Africanmissions abroad subject to presenting to the mission certifiedcopies of the two prescribed repatriation guarantees referred toabove.1.4 Diplomatic Properties/PremisesConstruction;relocation;renovation;replacing;extending;leasing1.4.1 In terms of Section 12 (1) of the Act, all foreign missions orconsular posts, the United Nations, its specialised agencies andinternational organisations must submit a written request to theDirector General of International Relations and Cooperation foracquiring, constructing, relocating, renovating, replacing, extendingor leasing immovable property.1.4.2 In terms of Section 12 (4) of the Act diplomatic missions must belocated in Pretoria or, during sessions of Parliament, in Cape Town.1.4.3 Despite subsection 12 (4) of the Act, the Minister of InternationalRelations and Cooperation may approve that a section of thediplomatic mission be located elsewhere, subject to the followingpre-requisites:(a)Only the economic section of a diplomatic mission headed by acareer diplomat can be located outside the capital;Page 17 of 90
