DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATION<strong>of</strong> <strong>the</strong> Republic <strong>of</strong> South Africad) “a spouse” means a pers<strong>on</strong> who <strong>the</strong> Department <strong>of</strong> Internati<strong>on</strong>al Relati<strong>on</strong>s <strong>and</strong> Cooperati<strong>on</strong>has recognised as such, accompanying a senior <strong>of</strong>ficial c<strong>on</strong>ferred with diplomatic status <strong>of</strong><strong>the</strong> Internati<strong>on</strong>al Organisati<strong>on</strong>1.3 Up<strong>on</strong> applicati<strong>on</strong>, a spouse can be authorized to engage in employment from <strong>the</strong> time <strong>of</strong>arrival <strong>of</strong> <strong>the</strong> <strong>of</strong>ficial <strong>of</strong> (Internati<strong>on</strong>al Organisati<strong>on</strong>) in South Africa to take up his orher post, until <strong>the</strong> time <strong>of</strong> departure <strong>of</strong> <strong>the</strong> latter up<strong>on</strong> terminati<strong>on</strong> <strong>of</strong> his or her duties.1.4 Authorisati<strong>on</strong> for a spouse to engage in employment will lapse <strong>on</strong> <strong>the</strong> datea) that <strong>the</strong> <strong>of</strong>ficial <strong>of</strong> <strong>the</strong> Internati<strong>on</strong>al Organisati<strong>on</strong>’s employment terminates; orb) <strong>the</strong> spouse ceases to have <strong>the</strong> status <strong>of</strong> a member <strong>of</strong> <strong>the</strong> family.1.5 Authorisati<strong>on</strong> for a spouse to engage in gainful employment will not imply exempti<strong>on</strong> fromany requirements which may ordinarily apply to any employment, whe<strong>the</strong>r relating to pers<strong>on</strong>alcharacteristics, pr<strong>of</strong>essi<strong>on</strong>al or trade qualificati<strong>on</strong>s or o<strong>the</strong>rwise.2. Immunity from Civil <strong>and</strong> Administrative Jurisdicti<strong>on</strong>2.1 In <strong>the</strong> case <strong>of</strong> a spouse enjoying immunity from <strong>the</strong> civil <strong>and</strong> administrative jurisdicti<strong>on</strong> <strong>of</strong> <strong>the</strong>Republic <strong>of</strong> South Africa by virtue <strong>of</strong> immunities c<strong>on</strong>ferred in terms <strong>of</strong> <strong>the</strong> Act, or any o<strong>the</strong>ragreement or arrangement which may apply between <strong>the</strong> Government <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> SouthAfrica <strong>and</strong> <strong>the</strong> Internati<strong>on</strong>al Organisati<strong>on</strong>, <strong>the</strong> Internati<strong>on</strong>al Organisati<strong>on</strong> will be requested towaive this immunity in respect <strong>of</strong> all matters arising out <strong>of</strong> <strong>the</strong> employment <strong>and</strong> falling within<strong>the</strong> civil or administrative law <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> South Africa.Page 64 <strong>of</strong> 90
