Immunity from Civil <strong>and</strong> Administrative Jurisdicti<strong>on</strong>2.1 In <strong>the</strong> case <strong>of</strong> a spouse enjoying immunity from <strong>the</strong> civil <strong>and</strong> administrative jurisdicti<strong>on</strong> <strong>of</strong> <strong>the</strong>receiving State in accordance with <strong>the</strong> <strong>Diplomatic</strong> C<strong>on</strong>venti<strong>on</strong>, <strong>the</strong> C<strong>on</strong>sular C<strong>on</strong>venti<strong>on</strong> or anyo<strong>the</strong>r agreement which may apply between <strong>the</strong> Governments, such a spouse who engages inpr<strong>of</strong>essi<strong>on</strong>al services for remunerati<strong>on</strong> outside <strong>the</strong> missi<strong>on</strong> will by virtue <strong>of</strong> Article 31.1(c) <strong>of</strong><strong>the</strong> <strong>Diplomatic</strong> C<strong>on</strong>venti<strong>on</strong> automatically not enjoy immunity from <strong>the</strong> civil <strong>and</strong> administrativejurisdicti<strong>on</strong> <strong>of</strong> <strong>the</strong> receiving State.2.2 In such a case, <strong>the</strong> sending State will be requested to c<strong>on</strong>sider waiving <strong>the</strong> immunity fromexecuti<strong>on</strong> <strong>of</strong> judgment against such a spouse.3. Immunity from Criminal Jurisdicti<strong>on</strong>In <strong>the</strong> case <strong>of</strong> a spouse enjoying immunity from <strong>the</strong> criminal jurisdicti<strong>on</strong> <strong>of</strong> <strong>the</strong> receiving Statein accordance with <strong>the</strong> <strong>Diplomatic</strong> C<strong>on</strong>venti<strong>on</strong>, <strong>the</strong> C<strong>on</strong>sular C<strong>on</strong>venti<strong>on</strong> or any o<strong>the</strong>ragreement which may apply between <strong>the</strong> Governments:(a)The sending State will be requested to c<strong>on</strong>sider waiving <strong>the</strong> immunity <strong>of</strong> <strong>the</strong> spousefrom <strong>the</strong> criminal jurisdicti<strong>on</strong> <strong>of</strong> <strong>the</strong> receiving State in respect <strong>of</strong> any act or omissi<strong>on</strong>arising from <strong>the</strong> employment; <strong>and</strong>(b)A waiver <strong>of</strong> immunity from criminal jurisdicti<strong>on</strong> will not be c<strong>on</strong>strued as extending toimmunity from executi<strong>on</strong> <strong>of</strong> <strong>the</strong> sentence, for which a separate waiver will be required.Page 59 <strong>of</strong> 90
