DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATIONpursuant to Article 41(1) of the Vienna Convention on Diplomatic Relationsof 1961 and Article 55(1) of the Vienna Convention on Consular Relations of1963.5.5 Default arbitration awardsIn the event that the CCMA has issued a default award against a Missionwhere the Mission has failed to make an appearance at the arbitration hearing,notwithstanding the fact that the prescribed procedure, as provided for in this<strong>Policy</strong>, has been complied with, the provisions of section 13(5) of the ForeignStates Immunities Act, 1981 (Act No. 87 of 1981) shall be applied whichstates:“A copy of any default judgment against a foreign state shall betransmitted through the Department of Foreign Affairs andInformation of the Republic to the ministry of foreign affairs of theforeign state, and any time prescribed by rules of court or otherwisefor applying to have the judgment set aside shall begin to run twomonths after the date on which the copy of the judgment is received atthat ministry.”5.6 Enforcement of arbitration awardsThe procedure contained in Part 4 (see paragraphs 4.2.3 to 4.2.9) of this <strong>Policy</strong>shall be applied to ensure compliance with any arbitration award issued by theCCMA.Page 90 of 90
