DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATIONPART 5: DISPUTES BY LOCALLY RECRUITED PERSONNELEMPLOYED AT MISSIONS IN THE RSA5.1 IntroductionObligations5.1.1 Diplomatic missions, consular posts, international organisations andpersons conferred with immunity have to respect the laws andregulations of the RSA as host State provided for in the Vienna andUnited Nations Conventions regulating privileges and immunities.5.1.2 Personnel employed locally by missions, consular posts, internationalorganisations as well as persons conferred with immunity, who areinvolved in disputes in terms of the Labour Relations Act, 1995 (Act66 of 1995) with the accredited diplomatic and internationalcommunities in South Africa could make use of the Department’sassistance through the CCMA, to pursue such labour disputes. In orderto apply a predictable process to manage such disputes lodged bylocally recruited personnel (LRP) against foreign states and/oraccredited international organisations represented in the RSA, theBranch: State Protocol, together with the OCSLA (IL) and the CCMAhave established guidelines for addressing such disputes.Page 83 of 90
