DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATIONan international agreement for the establishment of the Organisation’spresence in the Republic of South Africa.Standard HostCountryAgreement2.2.2 The immunities and privileges to be granted to internationalorganisations are harmonised through a Standard Host CountryAgreement in terms of the Act. A model Host Country Agreementcontaining standard text adopted by the Department shall be the basisfor all Host Agreements concluded with international organisations.The relevant Business Unit will consult OCSLA (IL) to prepare thedraft Host Country Agreement based on this model and standard text,which is applicable to the particular international organisation. It isimportant to note that the Government cannot grant more immunitiesand privileges than the Act provides for. It is also important to notethat the conclusion of each Host Country Agreement must complywith the Government’s Constitutional procedures for the conclusion ofinternational agreements, before implementation by the Department.Consultationprocess(a)(b)(c)This includes:Consultation with all stakeholders (including the South AfricanRevenue Service and the Branch: State Protocol);An opinion from the Department of Justice and ConstitutionalDevelopment on the Agreement’s consistency with domestic law;An opinion from the OCSLA (IL) on the Agreement’s consistencywith international law; andPage 44 of 90
