CHAPTER 11DEPARTMENTAL PROCEEDINGS AGAINSTPOLICEMEN & CRIME IN INDIAState/UT Wise Data on:• Departmental Proceedings against<strong>Police</strong>men• Incidence & Rate <strong>of</strong> Cognizable Crimesunder:- IPC (Indian Penal Code)- SLL (Special <strong>and</strong> Local Laws)• Disposal <strong>of</strong> Cases by Courts under:- IPC (Indian Penal Code)- SLL (Special <strong>and</strong> Local Laws)• No. <strong>of</strong> Exhibits awaiting examination in:- State & Regional FSLsThis chapter attempts to provide youwith State/UT wise data on DepartmentalProceedings against <strong>Police</strong> personnel, Incidence& Rate <strong>of</strong> cognizable crimes under ‘IndianPenal Code (IPC)’ <strong>and</strong> under the ‘Special &Local Laws (SLL)’, Disposal <strong>of</strong> under trial casesby the Subordinate Courts under IPc & SLL<strong>and</strong> number <strong>of</strong> Exhibits awaiting examinationin State & Regional FSLs.Departmental Proceedings Against<strong>Police</strong>menA total <strong>of</strong> 62,525 cases <strong>of</strong> departmentalproceedings, including those brought forwardfrom previous year against <strong>Police</strong> personnelwere processed during 2011. Of these cases,37,614 were initiated <strong>and</strong> subsequentlydisposed <strong>of</strong>f, amounting to 60.2% disposal<strong>of</strong> the total proceedings while 24,911proceedings remained pending for disposal ason 01.01.<strong>2012</strong>.At the state level the highest number <strong>of</strong>9,544 departmental proceedings were initiated<strong>and</strong> disposed <strong>of</strong> in Uttar Pradesh during theyear 2011, followed by 4,200 in Tamil Nadu<strong>and</strong> 4,041 in Andhra Pradesh. The Stateswhich have reported relatively higher number<strong>of</strong> proceedings pending as on 1.1.<strong>2012</strong> wereUttar Pradesh (2,965), Tamil Nadu (2,315) <strong>and</strong>Andhra Pradesh (2,077). Details are given inTable – 11.1. (Page No. 121)Cognizable Crime / Incidence & Rate <strong>of</strong>Crime (IPC)Cognizable Crime is defined as one inwhich a <strong>Police</strong> Officer may arrest an accusedwithout warrant. The police have a directresponsibility to take immediate action onreceipt <strong>of</strong> a complaint in such crimes by takingsteps like visit to the scene <strong>of</strong> the crime,investigate the facts, apprehend the <strong>of</strong>fender<strong>and</strong> produce him before a court <strong>of</strong> law havingjurisdiction over the matter.CRIME IN INDIAA total <strong>of</strong> 23,25,575 IPC crimes werereported in the country during the year 2011as against 22,24,831 in 2010, showing anincrease <strong>of</strong> 4.5 percent in 2011. At state levelMadhya Pradesh accounted for the maximum<strong>of</strong> 2,17,094 (9.3%) <strong>of</strong> total cognizable crimesregistered in the country followed by 2,04,902(8.8%) in Maharashtra <strong>and</strong> 1,95,135 (8.4%) inUttar Pradesh. This can be explained partlydue to decrease in actual crime <strong>and</strong> partly dueto improved registration <strong>of</strong> crime. Details aregiven in Table – 11.2.
