James Potter from <strong>the</strong> Sea Fenciblesto <strong>the</strong> <strong>Artillery</strong> company vice Calverly, whose appointmentwas cancelled ;promoting David Waterbury to be first lieutenantand appointing Caleb Ward, gentleman, to be secondlieutenant.On <strong>the</strong> 20th September, 1816, Major Ward issued an orderrequesting Captains Humbert, McKee and Potter to takecharge <strong>of</strong> <strong>the</strong>ir several companies agreeably to <strong>the</strong> generalorder partlyquoted above.It is, however, doubtful whe<strong>the</strong>r Captain Potter assumedcommand <strong>of</strong> <strong>the</strong> company, as on i8th April, 182 1, MajorWard recommended <strong>the</strong> promotion <strong>of</strong> David Waterbury to<strong>the</strong> captaincy ^vice Crookshank deceased' It is not at all likelythat this expression would have been used if Captain Potterhad been <strong>the</strong> <strong>of</strong>ficer retiring. At <strong>the</strong> same time he recommended<strong>the</strong> promotion <strong>of</strong> Caleb Ward to first lieutenant and<strong>the</strong> appointment <strong>of</strong> John C. Waterbury as second lieutenant.George Shore^ <strong>the</strong>n adjutant-general, replied on May ist,making <strong>the</strong> appointments as desired. The militia generalorders <strong>of</strong> loth August, 1821, <strong>of</strong> interest to <strong>the</strong> artillery, wereasfollows'Major Ward, commanding <strong>the</strong> St. John militia, having'expressed a wish to retire with his rank, <strong>the</strong> corps is to be'divided into two battalions, <strong>the</strong> first under Charles Drury,'Esq., <strong>the</strong> second under command <strong>of</strong> Charles Simonds, Esq.,'which gentlemen <strong>the</strong> commander-in-chief is pleased to appoint'majors commandant <strong>of</strong> <strong>the</strong> same. The companies at present'enrolled within <strong>the</strong> Umits <strong>of</strong> <strong>the</strong> city, including <strong>the</strong> Artil-'lery. Sea Fencibles and African companies are to form <strong>the</strong>'first battalion, <strong>the</strong> remaining companies are to form <strong>the</strong> second.'The commandants will recommend <strong>of</strong>ficers to complete <strong>the</strong>ir'corps agreeably to <strong>the</strong> proportion provided in <strong>the</strong> militia Act,'as also <strong>the</strong>ir staff, paying every possible attention to <strong>the</strong>
