<strong>Judicial</strong> <strong>System</strong> in Saudi Arabia<br />

Law of Criminal Procedure.<br />

As to voluntary independence i.e. that concerns the will<br />

of judges and their freedom and consciousness, we consider<br />

it as the most important aspect of the ‘independence of the<br />

judiciary, because the judiciary operation needs free will,<br />

integrity and discretion, so whenever these factors are<br />

available to judges, we expect judges to adjudicate freely<br />

and fairly; failing which, bribe, corruption and whims will<br />

prevail.<br />

All in all, the principle of the ‘independence of the<br />

judiciary’ remains a remarkable mantra advocated, for good<br />

or ill, by all countries as it symbolizes justice and integrity.<br />

This may appear in the form of general and flexible legal rules<br />

with wide interpretations and applications. Nevertheless, a<br />

country such as the Kingdom of Saudi Arabia, a pioneering<br />

country in applying the principles of Islamic Sharia, remains<br />

a focus of the international community. So any flaws or<br />

deficiencies, no matter how insignificant or minor, will be<br />

significant in the eyes of critics and will have negative effects<br />

beyond the discretion of judges in particular and upon the<br />

government in general. For that reason, judges must enjoy<br />

job security and as well social, political and intellectual<br />

freedoms – this is supposed to be provided by the country<br />

that lies at the heart of the Arab peninsula and embraces<br />

the Two Holy Mosques and as well adopting a moderate<br />

intellectual path.<br />
