says, “Let not the enmity and hatred of others make you<br />

avoid justice. Be just: that is nearer to piety”<br />

The Third: Equality Between People in Judgeship<br />

A characteristic of judgeship in Islam is that it does not<br />

differentiate between the powerful and the weak, a rich<br />

and a poor all are equal before the judiciary. The Prophet<br />

Mohammed (Allah’s blessing and prayers be upon him),<br />

once said ‘The people before you were ruined because when<br />

a noble person amongst them committed theft, they would<br />

leave him, but if a weak person amongst them committed<br />

theft, they would execute the legal punishment on him. By<br />

Allah, were Fatimah, the daughter of Muhammad, to commit<br />

the theft, I would have cut off her hand’. Justice becomes<br />

valueless if it applies solely to certain segment of people<br />

while others were not subject to the rules of Sharia, and<br />

judges should always bear in mind Allah’s Almighty saying,<br />

“And that when you judge between men, you judge with<br />

justice” (Surah An-Nisa, verse (58)).<br />

The Fourth: Sacrifice in Anticipation of Allah’s reward<br />

A Judge does not assume office to enjoy monthly<br />

remuneration and other pecuniary benefits, but sacrifice<br />

in anticipation of Allah’s reward. By supporting the weak<br />

people, enforces rights – in a sense he usually practices a<br />

religious ritual and not performing a worldly job. To that<br />

effect, Prophet Mohammed (Allah’s blessing and prayers<br />
