<strong>Judicial</strong> <strong>System</strong> in Saudi Arabia<br />

that tremendous literature in jurisprudence books, including<br />

the revelation, which is an enormous scientific heritage rich<br />

of applications through which Islamic scholars deal with<br />

people’s concerns and conditions. Though Sharia comprises<br />

specific texts; however, these texts embody omniscient<br />

connotation and controlling rules that govern secondary<br />

issues.<br />

Irrespective of the numerousness of facts and renewed<br />

events, we find in the Holy Quran, Hadith and in the sources<br />

and rules of jurisprudence an answer to each new issue and<br />

a response to each new event.<br />

As a general rule, a judge may not pass a ruling unless he<br />

is well-versed in the Holy Quran and its interpretations, and<br />

be versed in all matters pertaining to Hadith and capable to<br />

infer Sharia rules from both the Holy Quran and Hadith. If<br />

the judge is not capable to make that inference, as the case<br />

among people today, he should be at least knowledgeable<br />

in jurisprudence matters – major and minor issues. By<br />

jurisprudence, I mean our considerable jurisprudence which<br />

Allah’s judgment dictated to be collected and assembled<br />

in different known jurisprudential doctrines, that is to say,<br />

maintaining Sharia jurisprudence in four schools.<br />

These doctrines were codified and scrutinized against<br />

the texts of the Holy Quran and Hadith by major Sharia<br />

scholars, thus laying down all-inclusive sources and rules<br />

under which coverage was established for each new branch.<br />

Those major Sharia scholars took great pains to collect these<br />
