<strong>Judicial</strong> <strong>System</strong> in Saudi Arabia<br />

certain controls; and of paramount importance of these is to<br />

achieve public good, avoiding corruption and not inflicting<br />

harm on others. Freedom of opinion is endorsed by the Holy<br />

Quran in the verse, “Let there arise out of you a group of<br />

people inviting to all that is good (Islam), enjoining Al-<br />

Marouf (i.e. Islamic Monotheism and all that Islam orders one<br />

to do) and forbidding Ak-Munkar (polytheism and disbelief<br />

and all that Islam has forbidden” (Surah Al Imran). As well,<br />

freedom of expression in Islam is a right and duty according<br />

to the verse, “The believers, men and women, are Auliya<br />

(helpers, supporters, friends, protectors) of one another; they<br />

enjoin Al-Marouf (i.e. Islamic Monotheism and all that Islam<br />

orders one to do) and forbidding Ak-Munkar (polytheism<br />

and disbelief and all that Islam has forbidden” (Surah At-<br />

Taubah). And enjoining what is right and prevention of what<br />

is wrong in society is not restricted to religious and ritual<br />

matters, but extends to include other human and worldly<br />

matters. Islam has given paramount importance to freedom<br />

of opinion because it is a fundamental pillar of numerous<br />

Sharia rules. Prophet Mohammed (Allah’s blessing and<br />

peace be upon him) used to urge his followers to express their<br />

opinions and used to accept these views in public and private<br />

matters. Caliph to Prophet Mohammed (Allah’s blessing and<br />

peace be upon him) followed suit in encouraging others’<br />

opinions and embrace advice and reconsiders their positions<br />

whenever they believed others’ opinions were correct. It<br />

has been reported that First Caliph Abu Bakar (may Allah<br />
