towards harm<strong>on</strong>isati<strong>on</strong> by developing policy stances in cooperati<strong>on</strong> with the NCAs<br />

and relevant <str<strong>on</strong>g>ECB</str<strong>on</strong>g> business areas, with a view to achieving comm<strong>on</strong> <strong>supervisory</strong><br />

practices for authorisati<strong>on</strong> procedures.<br />

In additi<strong>on</strong> to the policy stances already approved in 2015 (such as those <strong>on</strong><br />

reputati<strong>on</strong>, time commitment and collective suitability), further stances were<br />

developed <strong>on</strong> the use of interviews as a tool for informati<strong>on</strong> gathering during fit and<br />

proper assessments, including recommended practices <strong>on</strong> c<strong>on</strong>ducting interviews. Fit<br />

and proper interviews will, as a rule, become mandatory for newly appointed CEO<br />

and chairman positi<strong>on</strong>s at significant stand-al<strong>on</strong>e banks and top banks of groups<br />

<strong>on</strong>ce <str<strong>on</strong>g>ECB</str<strong>on</strong>g> Banking Supervisi<strong>on</strong> has published its Guide to fit and proper<br />

assessments 30 . Policy stances were also developed <strong>on</strong> (i) the assessments of<br />

candidates’ experience, (ii) the uniform applicati<strong>on</strong> of c<strong>on</strong>diti<strong>on</strong>al approvals, and (iii)<br />

re-assessments. The process for assessing additi<strong>on</strong>al n<strong>on</strong>-executive directorships<br />

and the combinati<strong>on</strong> of chairman/CEO positi<strong>on</strong>s was also covered.<br />

For qualifying holdings, policy stances were developed that focus <strong>on</strong> the assessment<br />

of the “specific acquirers” as well as <strong>on</strong> the scope, procedural aspects and format of<br />

the decisi<strong>on</strong>s adopted by the <str<strong>on</strong>g>ECB</str<strong>on</strong>g>. Additi<strong>on</strong>al work <strong>on</strong> practices for assessing<br />

qualifying holding criteria is well advanced and is expected to be finalised in 2017.<br />

To support the effective implementati<strong>on</strong> of these policy stances, <str<strong>on</strong>g>ECB</str<strong>on</strong>g> Banking<br />

Supervisi<strong>on</strong> has invested significantly in training for staff and in communicati<strong>on</strong><br />

towards the banking sector and the wider public.<br />

With regard to licensing, work has started <strong>on</strong> developing policy stances relating to<br />

scope, assessment of licensing criteria and procedural issues relating to the process<br />

of granting licences. Another project has been started to develop a comm<strong>on</strong><br />

European banking supervisi<strong>on</strong> stance <strong>on</strong> the granting of banking licences to FinTech<br />

companies.<br />

2.2 <str<strong>on</strong>g>Report</str<strong>on</strong>g>ing of breaches, enforcement and sancti<strong>on</strong>ing<br />

proceedings<br />

2.2.1 Enforcement and sancti<strong>on</strong>ing<br />

Under the SSM Regulati<strong>on</strong> and the SSM Framework Regulati<strong>on</strong>, the allocati<strong>on</strong> of<br />

enforcement and sancti<strong>on</strong>ing powers between the <str<strong>on</strong>g>ECB</str<strong>on</strong>g> and the NCAs depends <strong>on</strong><br />

the nature of the alleged breach, the pers<strong>on</strong> resp<strong>on</strong>sible and the measure to be<br />

adopted (see <str<strong>on</strong>g>ECB</str<strong>on</strong>g> <str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>supervisory</strong> <strong>activities</strong> 2014).<br />

The draft Guide to fit and proper assessments was published for public c<strong>on</strong>sultati<strong>on</strong> <strong>on</strong> 14 November<br />

2016 in parallel to, and fully c<strong>on</strong>sistent with, the EBA c<strong>on</strong>sultati<strong>on</strong> of its revised Guidelines <strong>on</strong> suitability.<br />

Publicati<strong>on</strong> of the final guide is expected in the sec<strong>on</strong>d quarter of 2017.<br />
