4.4 Implementati<strong>on</strong> of the Code of C<strong>on</strong>duct<br />

Under Article 19(3) of the SSM Regulati<strong>on</strong>, the <str<strong>on</strong>g>ECB</str<strong>on</strong>g> is required to have a Code of<br />

C<strong>on</strong>duct that governs <str<strong>on</strong>g>ECB</str<strong>on</strong>g> staff and management involved in banking supervisi<strong>on</strong><br />

and that addresses in particular any c<strong>on</strong>cerns regarding c<strong>on</strong>flicts of interest. The<br />

relevant provisi<strong>on</strong>s are c<strong>on</strong>tained in the <str<strong>on</strong>g>ECB</str<strong>on</strong>g>’s Ethics Framework, which is<br />

implemented by the Compliance and Governance Office (CGO). The CGO advises<br />

all <str<strong>on</strong>g>ECB</str<strong>on</strong>g> staff <strong>on</strong> ethical issues.<br />

Throughout 2016 more than 1,500 requests were received by the CGO from <str<strong>on</strong>g>ECB</str<strong>on</strong>g><br />

staff members relating to a wide range of topics. One-third of those came from staff<br />

involved in banking supervisi<strong>on</strong> and c<strong>on</strong>cerned, inter alia, private financial<br />

transacti<strong>on</strong>s, post-employment restricti<strong>on</strong>s, gifts and hospitality and other c<strong>on</strong>cerns<br />

regarding c<strong>on</strong>flicts of interest (see Chart 10). The CGO identified a limited number of<br />

instances of n<strong>on</strong>-compliance, roughly <strong>on</strong>e-third of which related to staff and<br />

management involved in banking supervisi<strong>on</strong>. N<strong>on</strong>e of those instances related to<br />

intenti<strong>on</strong>al misc<strong>on</strong>duct or other serious instances of n<strong>on</strong>-compliance.<br />

Of those members of staff and management involved in banking supervisi<strong>on</strong> who<br />

resigned from their post in 2016, no case triggered a cooling-off period in line with<br />

the Ethics Framework.<br />

With a view to achieving an adequate corporate and ethics culture across the SSM,<br />

the NCAs have communicated to the <str<strong>on</strong>g>ECB</str<strong>on</strong>g> the measures they have taken to<br />

implement and comply with the <str<strong>on</strong>g>ECB</str<strong>on</strong>g>’s Guideline setting out the comm<strong>on</strong> principles of<br />

an Ethics Framework for both the <str<strong>on</strong>g>ECB</str<strong>on</strong>g> and NCAs. A dedicated ethics task force<br />

facilitated these <strong>activities</strong> and c<strong>on</strong>tinued to support the Governing Council in this<br />

respect.<br />

The <str<strong>on</strong>g>ECB</str<strong>on</strong>g>’s Ethics Committee advises members of those bodies that are involved in<br />

the <str<strong>on</strong>g>ECB</str<strong>on</strong>g>’s decisi<strong>on</strong>-making processes <strong>on</strong> ethical issues. It issued SSM-related<br />
