EU already take place under the terms of CRD IV, MoUs with European nati<strong>on</strong>al<br />
competent authorities lay down additi<strong>on</strong>al details <strong>on</strong> cooperati<strong>on</strong>.<br />
In December 2016 the <str<strong>on</strong>g>ECB</str<strong>on</strong>g> c<strong>on</strong>cluded an MoU with the <strong>supervisory</strong> authorities of<br />
Sweden, Norway, Denmark and Finland with regard to supervising branches that are<br />
c<strong>on</strong>sidered significant under CRD IV. The MoU covers matters related to <strong>on</strong>going<br />
supervisi<strong>on</strong>, such as participati<strong>on</strong> in <strong>supervisory</strong> colleges, the exchange of<br />
informati<strong>on</strong> and <strong>on</strong>-site inspecti<strong>on</strong>s. 32<br />
The <str<strong>on</strong>g>ECB</str<strong>on</strong>g> is also in discussi<strong>on</strong> with EU nati<strong>on</strong>al market authorities regarding the<br />
signature of an MoU based <strong>on</strong> the template previously devised by the <str<strong>on</strong>g>ECB</str<strong>on</strong>g> in<br />
cooperati<strong>on</strong> with ESMA. Such an MoU has already been signed with <strong>on</strong>e authority.<br />
Negotiati<strong>on</strong>s are under way with two other nati<strong>on</strong>al market authorities.<br />
The <str<strong>on</strong>g>ECB</str<strong>on</strong>g> has also entered into MoUs with both the EBA and ESMA.<br />
Cooperati<strong>on</strong> with third country authorities<br />
Over time, MoUs between NCAs<br />
and third countries will be replaced<br />
with MoUs between the <str<strong>on</strong>g>ECB</str<strong>on</strong>g> and<br />
third countries<br />
Where feasible, the <str<strong>on</strong>g>ECB</str<strong>on</strong>g> joined the existing MoUs that NCAs from euro area<br />
countries had signed with <strong>supervisory</strong> authorities from third countries before the<br />
SSM was established, so as to facilitate <strong>on</strong>going supervisi<strong>on</strong>. Over time, these MoUs<br />
will be progressively replaced with the <str<strong>on</strong>g>ECB</str<strong>on</strong>g>’s own MoUs with the third country<br />
authorities.<br />

This MoU is designed to facilitate cooperati<strong>on</strong> <strong>on</strong> significant branches between <str<strong>on</strong>g>ECB</str<strong>on</strong>g> Banking<br />
Supervisi<strong>on</strong> and the Nordic authorities (and for the latter am<strong>on</strong>g themselves), both inside and outside<br />
the euro area. Therefore, the MoU not <strong>on</strong>ly covers euro area entities but also a broader range of<br />
entities under the supervisi<strong>on</strong> of these Nordic authorities. Furthermore, in additi<strong>on</strong> to banking<br />
supervisi<strong>on</strong> tasks, the MoU also covers c<strong>on</strong>sumer protecti<strong>on</strong>, payment services and systems as well as<br />
anti-m<strong>on</strong>ey laundering. Hence, the MoU’s scope goes bey<strong>on</strong>d the tasks of <str<strong>on</strong>g>ECB</str<strong>on</strong>g> Banking Supervisi<strong>on</strong>.<br />
However, the degree of cooperati<strong>on</strong> between the signatory authorities remains subject to EU law.<br />
C<strong>on</strong>sequently, <str<strong>on</strong>g>ECB</str<strong>on</strong>g> Banking Supervisi<strong>on</strong> will participate in the MoU <strong>on</strong>ly with regard to its <strong>supervisory</strong><br />
tasks.<br />
