2016<br />
During the initial phase of European banking supervisi<strong>on</strong>, the focus was mainly <strong>on</strong><br />
gaining knowledge of the prudential situati<strong>on</strong> of the supervised entities (<strong>on</strong>ly four<br />
proceedings were initiated in 2015, of which two were also completed in 2015). In<br />
the course of 2016, the <str<strong>on</strong>g>ECB</str<strong>on</strong>g> launched 41 sancti<strong>on</strong>ing proceedings and <strong>on</strong>e<br />
enforcement proceeding which were related to suspected breaches committed by 36<br />
significant supervised entities.<br />
Taking into account two proceedings that were <strong>on</strong>going at end-2015, the <str<strong>on</strong>g>ECB</str<strong>on</strong>g><br />
handled 44 proceedings in 2016, 42 of them regarding sancti<strong>on</strong>s and two related to<br />
enforcement measures (see Table 6).<br />

Altogether, 30 out of the 42 sancti<strong>on</strong>ing proceedings handled in 2016 relate to<br />
suspected breaches of directly applicable EU law (<str<strong>on</strong>g>ECB</str<strong>on</strong>g> decisi<strong>on</strong>s and regulati<strong>on</strong>s<br />
included). These proceedings c<strong>on</strong>cern 26 significant supervised entities and relate to<br />
the areas of own funds, reporting, public disclosure, liquidity and large exposures.<br />
Two of the proceedings were closed during 2016, owing mainly to the absence of a<br />
legal basis for imposing sancti<strong>on</strong>s in the specific cases at hand. The investigati<strong>on</strong> of<br />
the other alleged breaches is <strong>on</strong>going.<br />
The remaining 12 out of the 42 sancti<strong>on</strong>ing proceedings are related to suspected<br />
breaches of nati<strong>on</strong>al law transposing CRD IV provisi<strong>on</strong>s and c<strong>on</strong>cern significant<br />
supervised entities or natural pers<strong>on</strong>s. These proceedings involve suspected<br />
breaches with regard to governance, including internal c<strong>on</strong>trol mechanisms,<br />
management body functi<strong>on</strong>s and remunerati<strong>on</strong>. Three of these proceedings were<br />
closed during 2016 owing to the n<strong>on</strong>-materiality of the suspected breaches. During<br />
2016, the <str<strong>on</strong>g>ECB</str<strong>on</strong>g> also addressed three requests to NCAs to open sancti<strong>on</strong>ing<br />
proceedings within the remit of their nati<strong>on</strong>al competences.<br />
The smooth cooperati<strong>on</strong> between<br />
the <str<strong>on</strong>g>ECB</str<strong>on</strong>g> and the NCAs is a key<br />
element in the exercise of the<br />
<str<strong>on</strong>g>ECB</str<strong>on</strong>g>’s enforcement and sancti<strong>on</strong>ing<br />
powers<br />
The two enforcement proceedings handled in 2016 c<strong>on</strong>cerned a suspected breach of<br />
nati<strong>on</strong>al remunerati<strong>on</strong> rules and n<strong>on</strong>-compliance with an <str<strong>on</strong>g>ECB</str<strong>on</strong>g> <strong>supervisory</strong> decisi<strong>on</strong>.<br />
One of the proceedings was closed in 2016 owing to the absence of a legal basis for<br />
imposing effective enforcement measures in that specific case, while the other is<br />
<strong>on</strong>going.<br />

the enforcement and sancti<strong>on</strong>ing proceedings handled in 2016 by the <str<strong>on</strong>g>ECB</str<strong>on</strong>g> is<br />
displayed in Chart 5.<br />
