• New M<strong>in</strong><strong>in</strong>g Charter gazetted <strong>in</strong> September 2018 and came <strong>in</strong>to <strong>for</strong>ce <strong>in</strong> March 2019.<br />

• Current M<strong>in</strong>eral and Petroleum Resources Development Act rema<strong>in</strong>s applicable, with the<br />

Amendment Bill hav<strong>in</strong>g been withdrawn to provide greater certa<strong>in</strong>ty <strong>for</strong> the m<strong>in</strong><strong>in</strong>g sector.<br />

• <strong>The</strong> Presidential Advisory Panel on Land Re<strong>for</strong>m and Agriculture, established <strong>in</strong> September 2018, put<br />

<strong>for</strong>ward several recommendations to correct the skewed distribution of land <strong>in</strong> <strong>South</strong> <strong>Africa</strong>. <strong>The</strong>se<br />

complement and re<strong>in</strong><strong>for</strong>ce the work undertaken by the Inter-M<strong>in</strong>isterial Committee on Land Re<strong>for</strong>m,<br />

chaired by the Deputy President. <strong>The</strong> panel’s report, which was presented to Cab<strong>in</strong>et, recommended,<br />

among others: legal mechanisms to recognise, record and en<strong>for</strong>ce a cont<strong>in</strong>uum of land rights; the<br />

identification by government of well-located and unused/under-utilised land and build<strong>in</strong>gs <strong>for</strong> the<br />

purpose of urban settlements; and a participatory and democratic, area-based approach to identify<strong>in</strong>g<br />

land needs. <strong>The</strong> panel also argued that expropriation without compensation is not, by itself, a solution<br />

to land re<strong>for</strong>m, but simply one of the means of acquir<strong>in</strong>g land.<br />

• A process is under way <strong>in</strong> the National Assembly to <strong>in</strong>itiate and <strong>in</strong>troduce the necessary legislation, tak<strong>in</strong>g<br />

<strong>in</strong>to consideration the work done and recommendations conta<strong>in</strong>ed <strong>in</strong> the reports of the Constitutional<br />

Review Committee and the Ad Hoc Committee on Amendment of Section 25 of the Constitution.<br />

• In l<strong>in</strong>e with the goal of mak<strong>in</strong>g it easier to do bus<strong>in</strong>ess <strong>in</strong> <strong>South</strong> <strong>Africa</strong> by reduc<strong>in</strong>g port and rail<br />

tariffs, the Ports Regulator announced a 6% decrease <strong>in</strong> tariffs <strong>in</strong> November 2018 and also<br />

lowered conta<strong>in</strong>er and automotive cargo dues. Commencement of the spectrum licens<strong>in</strong>g process<br />

is imm<strong>in</strong>ent, open<strong>in</strong>g up <strong>in</strong>vestment opportunities <strong>in</strong> the digital and telecoms sectors.<br />

• <strong>The</strong> government’s long-term energy plan is expressed <strong>in</strong> the Integrated Resource Plan (IRP) 2019.<br />

<strong>The</strong> IRP 2019 provides a roadmap <strong>for</strong> planned energy generation and the evolution of the energy<br />

mix over the period to 2050, outl<strong>in</strong><strong>in</strong>g a progressively lower relative contribution by coal-based<br />

electricity generation to total energy supply over time, towards an envisaged 58.8% by 2030.<br />

• Enhanced impetus <strong>for</strong> renewable energy to replace decommissioned coal generation capacity.<br />
