Summary<br />
The Assignment<br />
As a special commissioner, assisted by two reference groups, I have<br />
been appointed to review a number of issues relating to marriage<br />
and registered <strong>par</strong>tnership and to propose such amendments to the<br />
legislation as may be considered necessary. One of the reference<br />
groups comprises representatives of the Riksdag (Swedish Parliament)<br />
<strong>par</strong>ties and the other represents religious communities.<br />
One of my main tasks was to report on all of the reasons for or<br />
against allowing couples of the same sex to enter into marriage, to<br />
conduct a thorough analysis of these reasons, and then to adopt a<br />
position on whether marriage as hitherto should be reserved for a<br />
relationship between a man and a woman or whether it should also<br />
be opened up for couples of the same sex. The assignment also<br />
included reporting on which international private and procedural<br />
law issues marriage for couples of the same sex raises and<br />
deliberating on whether these call for any special regulation.<br />
Another main task was – regardless of my conclusions regarding<br />
the issue of marriage for couples of the same sex – to adopt a<br />
position on the formalities for entering into marriage. In this <strong>par</strong>t,<br />
the assignment included investigating the issue of whether those<br />
who wished to get married should also in future be able to choose<br />
between a marriage ceremony conducted within a religious<br />
community and a civil marriage ceremony or whether a marriage<br />
should only be allowed to be concluded by a civil procedure. Subject<br />
to the precondition that the current arrangement should be retained,<br />
another requirement was to adopt a position on whether amendments<br />
should be made as regards the powers of religious communities<br />
to represent the public when officiating at weddings. I was also<br />
assigned the task of investigating the formalities of marriage by a<br />
civil procedure.<br />
