MSHA PROGRAM POLICY MANUAL <strong>VOLUME</strong> V<br />

"Berm," as used in this Section, means a pile or mound of<br />

material at least axle high to the largest piece of equipment<br />

using such roadway <strong>and</strong> as wide at the base as the normal angle of<br />

repose provides. Where guardrails are used in lieu of berms,<br />

they shall be of substantial construction.<br />

The width of the haulage road does not preclude the need for<br />

berms or guardrails.<br />

77.1606 Loading <strong>and</strong> Haulage Equipment; Inspection <strong>and</strong><br />

Maintenance<br />

Mobile loading <strong>and</strong> haulage equipment shall be inspected by a<br />

competent person before such equipment is placed in operation at<br />

the beginning of each shift. Any defects found affecting safety<br />

during the required inspection shall be recorded <strong>and</strong> reported to<br />

the mine operator.<br />
