e. Custom microelectronic devices that are analog in<br />

nature (e.g. radio frequency amplifiers, custom analog<br />

hybrids) that do not contain any digital logic.<br />

4. The restriction in paragraph (b) <strong>of</strong> this clause may be waived<br />

upon request from the Contractor in accordance with<br />

subsection 225.7009-3 <strong>of</strong> the <strong>Defense</strong> Federal Acquisition<br />

Regulation Supplement. The Contractor must provide<br />

compelling rationale for waiver <strong>of</strong> this restriction, and the<br />

waiver must be approved in writing by the DOD Trusted<br />

Foundry Program Office.<br />

5. The Contractor shall retain records showing compliance with<br />

the restriction in paragraph (b) <strong>of</strong> this clause until 3 years after<br />

final payment and shall make the records available upon<br />

request <strong>of</strong> the Contracting Officer.<br />

6. The Contractor shall insert this clause, including this<br />

paragraph (f) in all subcontracts, except those for—<br />

f. Commercial items other than Application Specific<br />

Integrated Circuits; or<br />

g. Items that do not contain Application Specific<br />

Integrated Circuits<br />
