The labour legislative environment of the forensic expert’s work<br />
is very heterogeneous. Most experts work part-time as such and<br />
thereby make use of the infrastructure of their employer. Many<br />
experts are employed by the institutes of the Ministry of Justice.<br />
Compared to other EU states, independent experts are not very<br />
frequent. Those work as single persons or pensioners as they are<br />
not allowed to unite to expert offices or corporate enterprises.<br />
Regarding remuneration, the situation is rather bad. The (official)<br />
hourly charge for vehicle experts is 1600 HUF + 35% lump<br />
sum costs + VAT (1600 HUF are about. 6 – 7 €). The absurde contemporary<br />
situation is unbearable, even if the expert could charge<br />
two hour per day. (According to law, an additional factor of 2.5<br />
is allowed in exceptional cases.) The lump sum costs comprise<br />
(unrealistic low) costs for photocopies, photographs and travelling<br />
expenses. The amended code of civil procedure offers the possibility<br />
to settle the costs prior to the assignment of the expert.<br />

Mandates to an expert can comprise the following tasks and<br />
problems:<br />
• at-spot investigation of the accident (saving of traces, technical<br />
check of the vehicles, investigation on conspicuity)<br />
• biomechanical loading (usually together with a expert physician)<br />
• investigation on technical failures as a possible accident<br />
cause<br />
• damage calculation<br />
• vehicle identification, appraisement of vehicles<br />
• technical investigation of insurance fraud<br />
• appraisement of vehicle repairs<br />
• investigation on vehicle loading and load fixation<br />
miscellaneous<br />
The majority of vehicle experts are members of the EVU Hungary<br />
and take part in the further training that has been organised by<br />
EVU Hungary and the IbB for years. (IbB is a German franchise<br />
corporation regarding accident reconstruction.)<br />
Some reconstructionists (their amount is growing continuously)<br />
take part in conferences abroad (EVU, AREC, DEKRA, MAS,<br />
DSD, IbB, etc.).<br />
Additionally, the developers of accident simulation software<br />
organise seminars, though their prices are considered somewhat<br />
steep (especially for the up-to-date versions). In Hungary, we use<br />
the following programs: Carat, PC-Crash, Analyzer, IbB’s additional<br />
modules, etc.<br />
The journals “Verkehrsunfall und Fahrzeugtechnik” respectively<br />
“ATZ” (Automobiltechnische Zeitschrift) are read on a regular basis.<br />
An independent Hungarian journal still has to be founded, but the<br />
journal of the national chamber of experts may allow exchange<br />
of experience.<br />
Concluding remarks<br />
The situation of the vehicle experts is characterised by an<br />
extreme amount of problems arising from the 15 idle years since<br />
the political turn. This may have been illustrated by the facts<br />
mentioned in this text. Perhaps, the problems originate from<br />
the fact that reforms in jurisdiction have left the expert sector<br />
unchanged (for what reasons ever). The Ministry of Justice is plan-<br />

ning to introduce a bill on expertship. Doing so, we may expect<br />
the following changes:<br />
• gradual increasing autonomy of the chamber of forensic<br />
experts in regard to accreditation and rejection of experts<br />
• normative regulation of the licensing, the prerequisites and<br />
the maximum duration of the admittance procedure<br />
• allowance for appeals regarding the decisions of the court<br />
experts commission<br />
• prescription of an obligatory education and examination in<br />
regard to law<br />
• reduce of the influence that the Ministry of justice has in<br />
regard to the chamber of forensic experts, precise definition<br />
of the content of the juridical supervision<br />
• reorganisation of the juridical tariff system with partial opening<br />
of the magisterial fixed price system<br />
• allowance for court experts to unite to economic corporations<br />
• new regulations on the work of superior expert commissions<br />
• successive transformation of the forensic institutions into<br />
acquisitive organs<br />
• allowance to certify court experts in an independent procedure
