ARTICLE 41<br />

On petition <strong>of</strong> twenty-five (25) or more registered voters <strong>of</strong> <strong>the</strong><br />

<strong>Town</strong> <strong>of</strong> <strong>Hampton</strong>, to see if <strong>the</strong> <strong>Town</strong> will vote to authorize <strong>the</strong><br />

Selectmen to convey to Barry Whiting that portion <strong>of</strong> <strong>the</strong> no longer used<br />

portion <strong>of</strong> Beach Plum Way which bisects Lot 535 on <strong>Town</strong> Assessor's Map<br />

132 at its assessed value and upon such o<strong>the</strong>r terms and conditions as<br />

<strong>the</strong> Selectmen may deem appropriate.<br />

ARTICLE 42<br />

To see <strong>of</strong> <strong>the</strong> <strong>Town</strong> will vote to amend Chapter 4, Article 4,<br />

Section 4 <strong>of</strong> <strong>the</strong> <strong>Town</strong>'s Code <strong>of</strong> Ordinances concerning licensing fees<br />

for coin operated amusement devices from : The fee for such license<br />

shall be in <strong>the</strong> amount <strong>of</strong> Two Dollars ($2.00) for any such hall, walk,<br />

structure or building containing one or two such devices and Ten<br />

Dollars ($10.00) for any hall, walk, structure or building containing<br />

three (3) or more such devices" (<strong>Town</strong> Meeting 3/6/76) so that it will<br />

read:<br />

Sec. 4:404 Fee<br />

The annual fee for such license shall be in <strong>the</strong> amount <strong>of</strong> Ten Dollars<br />

($10.00) for any such hall, walk, room, structure or building<br />

containing one (1) or two (2) such devices, and Ten Dollars ($10.00)<br />

plus Two Dollars ($2.00) per device over two (2) in number for any hall<br />

walk, structure or building containing three (3) or more such devices<br />

(Effective April 1, 1992; <strong>Town</strong> Meeting 3/14/92)<br />

(Note: The Zoning Ordinance defines "Penny Arcade" as "three or more<br />

amusement devices or gaming machines" and controls <strong>the</strong> establishment or<br />

expansion <strong>of</strong> such in all Districts.)<br />

ARTICLE 43<br />

To see <strong>of</strong> <strong>the</strong> <strong>Town</strong> will vote to amend <strong>the</strong> <strong>Hampton</strong> <strong>Town</strong> Ordinances,<br />

Chapter 6, Fire Codes, Article 2, Automatic Telephone Dialers/Fire<br />

Alarm, by deleting <strong>the</strong> same and substituting in place <strong>the</strong>re<strong>of</strong> <strong>the</strong><br />

following:<br />

AUTOMATIC TELEPHONE DIALERS/FIRE PROTECTION/ALARM SYSTEMS<br />

Sec. 6:201 Definitions<br />

Fire Protection/Alarm Systems: Any assembly <strong>of</strong> equipment and/or<br />

devices which, with or without human involvement, is reasonably<br />

calculated to notify ei<strong>the</strong>r police or fire <strong>of</strong>ficials and lead <strong>the</strong>m to<br />

believe that <strong>the</strong>re is a situation requiring <strong>the</strong>ir urgent attention.<br />

Unfounded Emergency Calls : Any response by police or fire <strong>of</strong>ficial to<br />

<strong>the</strong> activation <strong>of</strong> a fire protection/alarm system, when no objective<br />

indication <strong>of</strong> a situation requiring <strong>the</strong>ir urgent attention is found by<br />

<strong>the</strong> responding police or fire <strong>of</strong>ficials.<br />

Automatic Telephone Dialers : A private fire protection/alarm equipment<br />

arranged to automatically transmit a signal to <strong>the</strong> fire department over<br />

commercial telephone lines.<br />
