Mechanical Protection Device: An electrically operated instrument<br />

composed <strong>of</strong> sensory apparatus and related hardware which automatically<br />

sends over regular telephone lines, by direct communication or<br />

o<strong>the</strong>rwise, a prerecorded voice alarm upon receipt <strong>of</strong> a stimulus from<br />

<strong>the</strong> sensory apparatus that has detected a condition inherently<br />

characteristic <strong>of</strong> a fire or do not take any action in this matter.<br />

Owner: Any person who alone, or jointly or severally with o<strong>the</strong>rs,<br />

shall have legal title to any building, structure or premises with or<br />

without accompanying actual possession <strong>the</strong>re<strong>of</strong>.<br />

Sec. 6:202 Prohibited<br />

It shall be unlawful to install a mechanical protection device that is<br />

automatically keyed to and/or activates <strong>the</strong> telephone (numbers) lines<br />

controlled by and/or listed to <strong>the</strong> <strong>Hampton</strong> Fire Department.<br />

All such existing devices, installed prior to <strong>the</strong> effective date <strong>of</strong><br />

this ordinance, shall be removed within sixty (60) days from <strong>the</strong> date<br />

<strong>of</strong> passage <strong>of</strong> this ordinance.<br />

Sec. 6:203 Permissible Unfounded Emergency Calls<br />

The owner <strong>of</strong> any premises served by a fire protection/alarm system<br />

shall be permitted <strong>the</strong> following number <strong>of</strong> unfounded emergency calls<br />

prior to <strong>the</strong> imposition <strong>of</strong> a service charge.<br />

(A) Unfounded emergency calls to <strong>the</strong> fire <strong>of</strong>ficial if alarm system has<br />

been properly inspected/serviced within one (1) year <strong>of</strong> <strong>the</strong> alarms and<br />

a copy <strong>of</strong> inspection <strong>report</strong> has been filed with <strong>the</strong> Fire Department by<br />

<strong>the</strong> owner: Two (2) calls per six calendar month period (January to<br />

June, or July to December, inclusive)<br />

Sec. 6:204 Service Charge<br />

The owner <strong>of</strong> any premises served by a fire protection/alarm system<br />

shall be obligated to pay a service charge to <strong>the</strong> <strong>Town</strong> <strong>of</strong> <strong>Hampton</strong> for<br />

all unfounded emergency calls to that premises in excess <strong>of</strong> <strong>the</strong> number<br />

<strong>of</strong> calls permitted by this Article. This service charge shall be in<br />

<strong>the</strong> amount <strong>of</strong> Twenty-five ($2 5.00) Dollars per unfounded emergency<br />

calls to <strong>the</strong> fire <strong>of</strong>ficials as outlined in Section 6:203 (A) or <strong>the</strong><br />

amount <strong>of</strong> One Hundred Fifty Dollars {$150.00) per unfounded emergency<br />

calls to fire <strong>of</strong>ficials as outlined in Section 6:203(B). Said charge<br />

is to be paid within thirty (30) days <strong>of</strong> billing. Payment to be made<br />

to <strong>the</strong> <strong>Town</strong> <strong>of</strong> <strong>Hampton</strong>.<br />

Sec. 6:205 Penalty<br />

Any person, firm, or corporation, violating <strong>the</strong> provisions <strong>of</strong> this<br />

ordinance, shall be liable to a penalty <strong>of</strong> not more than One Hundred<br />

($100.00) Dollars for each <strong>of</strong>fense. Each day <strong>of</strong> violation shall be<br />

considered a separate <strong>of</strong>fense.<br />
