ARTICLE 51:<br />

On petition <strong>of</strong> Ellen D. Goe<strong>the</strong>l as a representative <strong>of</strong> <strong>the</strong> <strong>Hampton</strong> 4H<br />

Ocean Explorers, a group <strong>of</strong> school ^children and 25 or more registered<br />

voters <strong>of</strong> <strong>the</strong> <strong>Town</strong> <strong>of</strong> <strong>Hampton</strong>:<br />

To see if <strong>the</strong> <strong>Town</strong> will Vote to ban <strong>the</strong> use <strong>of</strong> Polystyrene foam<br />

(styr<strong>of</strong>oam) food containers by all retail food vendors and food packagers.<br />

This article shall take affect as <strong>of</strong> January 1, 1992 to allow all vendors to<br />

use back stock <strong>of</strong> polystyrene materials. After this date no retail food vendor<br />

shall serve or sell prepared food and no food packager shall package meat,<br />

eggs, bakery products, or o<strong>the</strong>r food in polystyrene foam containers. Also<br />

as <strong>of</strong> this date no vendor in <strong>the</strong> <strong>Town</strong> <strong>of</strong> <strong>Hampton</strong> who sells tangible<br />

personal property at retail shall sell polystyrene food or beverage containers.<br />

Violations <strong>of</strong> this Ordinance shall be punishable by fines as follows:<br />

A. A fine not exceeding $250.00 for <strong>the</strong> first violation in a one-year<br />

period.<br />

B. A fine not exceeding $500.00 for <strong>the</strong> second and each subsequent<br />

violation in a one-year period.<br />

The effective date <strong>of</strong> this ordinance shall be postponed if and as long as<br />

<strong>the</strong>re is developed and maintained an effective <strong>Town</strong>-wide Recycling<br />

Program for polystyrene foam food and beverage containers.<br />

If any part or provision <strong>of</strong> this Ordinance or <strong>the</strong> application <strong>the</strong>re<strong>of</strong> to<br />

any person or circumstances is held invalid, <strong>the</strong> remainder <strong>of</strong> <strong>the</strong> Ordinance,<br />

including <strong>the</strong> application <strong>of</strong> such part <strong>of</strong> provision to o<strong>the</strong>r persons or<br />

circumstances shall continue in full force and effect. To this end, provisions<br />

<strong>of</strong> this Ordinance are severable.<br />

4H Ocean Explorers Eric Goe<strong>the</strong>l and Russell Dover were allowed to<br />

speak and gave an excellent presentation <strong>of</strong> this article.<br />
