(3) The Board of Review shall hear disputes between Fellows, between
Chapters, between Fellows and Chapters and between Fellows and the
Academy and make recommendations to the Board for the resolution of
such disputes;
(4) The Board of Review may make recommendations for the discipline of
any Fellow or Chapter after following the procedure set out at 8.2 c below;
and
(5) The Board of Review shall also hear such other matters as are
submitted to it by the Board for its consideration and opinion.
Composition of the Board of Review
(1) The Board of Review shall consist of the Immediate Past President,
who shall serve as chair, the President-Elect, the two Vice Presidents who
have served longest in that position and two members of the Board of
Governors who are not presently officers and who shall be appointed by
the President. In the event that there is no Immediate Past President or he
or she is unable to serve as chair, the remaining members shall elect their
chair. Any Fellow who is the subject of a dispute or inquiry is disqualified
from sitting on the Board of Review.
(2) If a member of the Board of Review refuses, is disqualified, or is unable
to serve, the President shall appoint another Past President (or if none, a
past Governor) to substitute for the position of Immediate Past President,
another officer to substitute for the position of President-Elect or Vice
President or another Governor to substitute for a member of the Board of
Review.
(3) In the event a hearing is commenced by the Board of Review, those
then serving shall complete the proceeding even if their term of office
expires in the meantime, if a member dies, resigns or becomes disqualified
or if a Governor becomes an officer.
Hearings and Recommendations
(1) The Board of Review shall make no recommendation pursuant to 8.2 c
3. until such Fellow or Chapter has been sent written notice which:
(i)
(ii)
provides notice of the charges; and
extends the privilege of a hearing (with or without counsel as the
Fellow or Chapter may elect) before the Board of Review.
(2) The hearing shall be closed unless a written request for an open
hearing is made to the Board of Review by the Fellow who is the subject of
the hearing.
(3) An affirmative vote of at least two-thirds of the members of the Board of
Review is required before any recommendation may be transmitted to the
Board.
(4) Recommendations, findings and opinions submitted by the Board of
Review to the Board shall indicate the number of votes for or against each
proposition. Minority or concurring findings, opinions and recommendations
may also be made.
