(3) The Board <strong>of</strong> Review shall hear disputes between Fellows, between<br />
Chapters, between Fellows and Chapters and between Fellows and the<br />
<strong>Academy</strong> and make recommendations to the Board for the resolution <strong>of</strong><br />
such disputes;<br />
(4) The Board <strong>of</strong> Review may make recommendations for the discipline <strong>of</strong><br />
any Fellow or Chapter after following the procedure set out at 8.2 c below;<br />
and<br />
(5) The Board <strong>of</strong> Review shall also hear such other matters as are<br />
submitted to it by the Board for its consideration and opinion.<br />
Composition <strong>of</strong> the Board <strong>of</strong> Review<br />
(1) The Board <strong>of</strong> Review shall consist <strong>of</strong> the Immediate Past President,<br />
who shall serve as chair, the President-Elect, the two Vice Presidents who<br />
have served longest in that position and two members <strong>of</strong> the Board <strong>of</strong><br />
Governors who are not presently <strong>of</strong>ficers and who shall be appointed by<br />
the President. In the event that there is no Immediate Past President or he<br />
or she is unable to serve as chair, the remaining members shall elect their<br />
chair. Any Fellow who is the subject <strong>of</strong> a dispute or inquiry is disqualified<br />
from sitting on the Board <strong>of</strong> Review.<br />
(2) If a member <strong>of</strong> the Board <strong>of</strong> Review refuses, is disqualified, or is unable<br />
to serve, the President shall appoint another Past President (or if none, a<br />
past Governor) to substitute for the position <strong>of</strong> Immediate Past President,<br />
another <strong>of</strong>ficer to substitute for the position <strong>of</strong> President-Elect or Vice<br />
President or another Governor to substitute for a member <strong>of</strong> the Board <strong>of</strong><br />
Review.<br />
(3) In the event a hearing is commenced by the Board <strong>of</strong> Review, those<br />
then serving shall complete the proceeding even if their term <strong>of</strong> <strong>of</strong>fice<br />
expires in the meantime, if a member dies, resigns or becomes disqualified<br />
or if a Governor becomes an <strong>of</strong>ficer.<br />
Hearings and Recommendations<br />
(1) The Board <strong>of</strong> Review shall make no recommendation pursuant to 8.2 c<br />
3. until such Fellow or Chapter has been sent written notice which:<br />
(i)<br />
(ii)<br />
provides notice <strong>of</strong> the charges; and<br />
extends the privilege <strong>of</strong> a hearing (with or without counsel as the<br />
Fellow or Chapter may elect) before the Board <strong>of</strong> Review.<br />
(2) The hearing shall be closed unless a written request for an open<br />
hearing is made to the Board <strong>of</strong> Review by the Fellow who is the subject <strong>of</strong><br />
the hearing.<br />
(3) An affirmative vote <strong>of</strong> at least two-thirds <strong>of</strong> the members <strong>of</strong> the Board <strong>of</strong><br />
Review is required before any recommendation may be transmitted to the<br />
Board.<br />
(4) Recommendations, findings and opinions submitted by the Board <strong>of</strong><br />
Review to the Board shall indicate the number <strong>of</strong> votes for or against each<br />
proposition. Minority or concurring findings, opinions and recommendations<br />
may also be made.<br />
