The proposed drag races will be restricted to <strong>the</strong> north-eastern end <strong>of</strong> <strong>the</strong> runway.<br />

The airport will NOT be closed to air traffic during <strong>the</strong> proposed event, both private<br />

and emergency aircraft will be permitted to take <strong>of</strong>f and land as normal. When a<br />

plane is coming in to land or taxiing out for take-<strong>of</strong>f <strong>the</strong> drag races will be required<br />

to cease until <strong>the</strong> take-<strong>of</strong>f/landing is complete. Conditions are recommended that<br />

will ensure that <strong>the</strong> proposal means to permit take-<strong>of</strong>f and landings meet CASA<br />

requirements (See Airport Regulations).<br />

Heads <strong>of</strong> Consideration<br />

The matter has been assessed in accordance with <strong>the</strong> Heads <strong>of</strong> Consideration as<br />

identified by Section 79C (1) <strong>of</strong> <strong>the</strong> Environmental Planning and Assessment Act<br />

1979, with <strong>the</strong> following matters <strong>of</strong> particular relevance.<br />

Kempsey Local Environmental Plan 1987<br />

The proposal is within <strong>the</strong> 1(a1) (Rural "A1" Zone). The proposal may be defined as<br />

a “recreation area” which is permissible with consent.<br />

The proposed drag racing event is consistent with <strong>the</strong> objectives <strong>of</strong> <strong>the</strong> 1(a1) Rural<br />

Zone, as follows:<br />

Zone 1(a1) objectives<br />

Predominantly to provide for<br />

agricultural uses;<br />

To preserve <strong>the</strong> visual amenity <strong>of</strong> <strong>the</strong><br />

land; and<br />

To provide for compatible tourist and<br />

industrial uses.<br />

Does proposal comply with objective?<br />

The proposed event is a co-location <strong>of</strong> uses on<br />

<strong>the</strong> existing airport which has limited<br />

agricultural potential.<br />

The proposal will not be visually intrusive or<br />

block significant views.<br />

The proposal has <strong>the</strong> potential to generate<br />

tourism in <strong>the</strong> Shire for <strong>the</strong> duration <strong>of</strong> <strong>the</strong><br />

event which is likely to have a flow-on financial<br />

stimulus for local businesses.<br />

Clause 41 <strong>of</strong> <strong>the</strong> KLEP 1987 addresses development near aerodromes, however <strong>the</strong><br />

proposal is not a type <strong>of</strong> development listed and so Clause 41 does not apply.<br />

Clause 56 <strong>of</strong> <strong>the</strong> KLEP 1987 requires <strong>Council</strong> to consider <strong>the</strong> impacts <strong>of</strong> <strong>the</strong> proposal<br />

on any acid sulfate soils. The site contains Class 5 acid sulfate soils and <strong>the</strong><br />

proposed event requires no excavation works, <strong>the</strong>refore no acid soils will be<br />

disturbed.<br />

State Environmental Planning Policy (Rural Lands) 2008<br />

Apart from residential uses, neighbouring properties are generally used for lowscale<br />

cattle grazing and fodder cropping. The proposal will not conflict with any<br />

adjoining agricultural industry.<br />

State Environmental Planning Policy (Temporary Structures) 2010<br />

The proposed event will include stalls and o<strong>the</strong>r temporary structures. The<br />

proposed temporary structures comply with <strong>the</strong> SEPP, as follows:<br />

Sanitary facilities are proposed as part <strong>of</strong> <strong>the</strong> event and required as part <strong>of</strong><br />

<strong>the</strong> Event Management Plan;<br />
