I intend to move <strong>the</strong> following Motion at <strong>the</strong> Ordinary <strong>meeting</strong> to be held Tuesday<br />

<strong>25</strong> <strong>September</strong> <strong>2012</strong>:<br />

“1 That <strong>Council</strong> remove <strong>the</strong> fire damaged structure known as <strong>the</strong> Beach<br />

Shelter at Horseshoe Bay, South West Rocks as a matter <strong>of</strong> urgency.<br />

2 That <strong>Council</strong> ensures that <strong>the</strong> site <strong>of</strong> <strong>the</strong> former Beach Shelter at<br />

Horseshoe Bay, South West Rocks is cleared <strong>of</strong> all materials and<br />

debris by 1 December <strong>2012</strong>.<br />

3 That <strong>Council</strong> completes <strong>the</strong> Master Plan for Horseshoe Bay, South<br />

West Rocks as a high priority to allow <strong>the</strong> replacement <strong>of</strong> a suitable<br />

facility in a timely manner.”<br />

MOTION IMPLICATIONS<br />

Environmental: The fire damaged structure is unsightly in appearance, is a blight<br />

on <strong>the</strong> landscape and portrays a less than acceptable attitude by <strong>Council</strong>, to both<br />

<strong>the</strong> local residents and tourists, for <strong>the</strong> appearance <strong>of</strong> Horseshoe Bay and for <strong>the</strong><br />

safety and amenity for visitors to <strong>the</strong> area.<br />

Social: The Horseshoe Bay Beach Shelter structure has for many years provided an<br />

important ga<strong>the</strong>ring point for locals and tourists. This structure was damaged by<br />

fire in mid-May <strong>2012</strong>. It is considered unacceptable and demonstrates a complete<br />

lack <strong>of</strong> care by Kempsey Shire <strong>Council</strong> for <strong>the</strong> appearance <strong>of</strong> Horseshoe Bay and<br />

subsequent tourism and business operators in South West Rocks. It is considered<br />

that this structure should have been removed and <strong>the</strong> site remediated prior to <strong>the</strong><br />

commencement <strong>of</strong> <strong>the</strong> school holidays on 22 <strong>September</strong> <strong>2012</strong>. It is considered<br />

imperative that, as a minimum, <strong>the</strong> beach shelter structure, which is an unsightly<br />

blight on <strong>the</strong> landscape, be removed prior to <strong>the</strong> October long weekend.<br />

Economic (Financial): The additional financial impact in removing <strong>the</strong> structure<br />

prior to its eventual replacement is considered minimal. The additional cost could<br />

be considered as part <strong>of</strong> <strong>the</strong> overall budget for <strong>the</strong> replacement <strong>of</strong> <strong>the</strong> Beach<br />

Shelter. <strong>Council</strong> also needs to consider <strong>the</strong> potential impost on <strong>Council</strong> should a<br />

person or property be damaged as a result <strong>of</strong> an accident associated with <strong>the</strong><br />

structure. In addition, <strong>the</strong> potential loss <strong>of</strong> trade and subsequent financial impact<br />

on tourism and business operators, which could be considerable, due to <strong>the</strong> loss <strong>of</strong><br />

reputation as a tourist destination, needs to be considered.<br />

Policy or Statutory: There are no known Policy or Statutory reasons for <strong>the</strong> Beach<br />

Shelter not to be removed, particularly given <strong>the</strong> fact that <strong>Council</strong> has been advised<br />

that <strong>the</strong> insurance claim for <strong>the</strong> structure has been finalised.<br />

I have not given <strong>the</strong> General Manager permission to comment on my notice <strong>of</strong><br />

motion.<br />

Removal <strong>of</strong> <strong>the</strong> damaged structure could not proceed until <strong>the</strong> insurance claim was<br />

finalised. This was included in <strong>the</strong> response to <strong>the</strong> question asked by Cr Gribbin<br />
