Section 10A(2)(c) – Commercial Advantage in Business Dealing<br />
This item is classified CONFIDENTIAL under section 10A(2)(c) <strong>of</strong> <strong>the</strong> Local<br />
Government Act 1993, which permits <strong>the</strong> <strong>meeting</strong> to be closed to <strong>the</strong> public for<br />
business relating to <strong>the</strong> following:<br />
(c) information that would, if disclosed, confer a commercial advantage on a<br />
person with whom <strong>the</strong> council is conducting business.<br />
It is not in <strong>the</strong> public interest to reveal <strong>the</strong> financial details associated with <strong>the</strong><br />
proposed land acquisition <strong>of</strong> <strong>the</strong> land as it will confer a commercial advantage on<br />
<strong>the</strong> parties with whom <strong>the</strong> <strong>Council</strong> is conducting business.<br />

relating to <strong>the</strong> lease <strong>of</strong> land at Kempsey Airport.<br />

That <strong>Council</strong> endorse <strong>the</strong> heads <strong>of</strong> agreement identified in <strong>the</strong> body <strong>of</strong> this<br />
report to form <strong>the</strong> foundation <strong>of</strong> a memorandum <strong>of</strong> understanding between<br />
<strong>the</strong> leasee and <strong>Council</strong>.<br />

This report is submitted on a confidential basis as it involves personnel matters<br />
concerning particular individuals (o<strong>the</strong>r than <strong>Council</strong>lors). (Local Government Act<br />

On balance, <strong>the</strong> public interest in preserving <strong>the</strong> confidentiality <strong>of</strong> <strong>the</strong> commercial<br />
information supplied, outweighs <strong>the</strong> public interest in openness and transparency in<br />
council decision making by discussing <strong>the</strong> matter in open <strong>meeting</strong>.<br />
