Section 10A(2)(c) – Commercial Advantage in Business Dealing
This item is classified CONFIDENTIAL under section 10A(2)(c) of the Local
Government Act 1993, which permits the meeting to be closed to the public for
business relating to the following:
(c) information that would, if disclosed, confer a commercial advantage on a
person with whom the council is conducting business.
It is not in the public interest to reveal the financial details associated with the
proposed land acquisition of the land as it will confer a commercial advantage on
the parties with whom the Council is conducting business.

Reporting on a draft Memorandum of Understanding that has been negotiated
relating to the lease of land at Kempsey Airport.

That Council endorse the heads of agreement identified in the body of this
report to form the foundation of a memorandum of understanding between
the leasee and Council.

This report is submitted on a confidential basis as it involves personnel matters
concerning particular individuals (other than Councillors). (Local Government Act
1993, section 10A(2)(a))
On balance, the public interest in preserving the confidentiality of the commercial
information supplied, outweighs the public interest in openness and transparency in
council decision making by discussing the matter in open meeting.
