Article 56. To see what sum the <strong>Town</strong> will vote to raise and appropriate for the Conservation<br />
Commission.<br />

Article 57. Shall an ordinance entitled “Shellfish Conservation Ordinance, <strong>Town</strong> <strong>of</strong> <strong>Phippsburg</strong>”<br />
(enacted May 17, 2000 as amended through May 1, <strong>2012</strong>) be amended as follows:<br />
“Shellfish Conservation Ordinance, <strong>Town</strong> <strong>of</strong> <strong>Phippsburg</strong>”<br />

Section 6.C.(6) (a) Surrender <strong>of</strong> License<br />
(6) Surrender <strong>of</strong> License:<br />
(a) Any licensee may surrender his or her license and receive a refund <strong>of</strong> the fee paid, prorated<br />
for the remaining term <strong>of</strong> the license, less a ten percent (10%) administrative fee to<br />
be retained by the <strong>Town</strong>. Once a license is issued for a harvest year it cannot be surrendered<br />
by the license holder during that year unless:<br />
(i) The license holder has died (automatic surrender); OR<br />
(ii) The license is surrendered by a Military Reservist who is called to active duty in<br />
accordance with section 6.C.(6)(b).<br />
(c) If a license is surrendered in accordance with section 6.C.(6)(a)(i) & (ii) the license holder<br />
(or family in the case <strong>of</strong> death) will receive a refund <strong>of</strong> the fee paid, prorated for the<br />
remaining term <strong>of</strong> the license. If a license is surrendered due to death it may be reissued<br />
upon vote <strong>of</strong> the Shellfish Commission.<br />
Section 6.C.(11) Suspension (automatic)<br />
(d) If a license holder pays for their shellfish license by check and the check is returned for insufficient<br />
funds the holder will be notified by the <strong>Town</strong> Treasurer or designee and will have<br />
30 calendar days to pay the town for the license and associated insufficient funds fees. If<br />
not settled within the 30 day period the license will be suspended.<br />
(Selectmen and Shellfish Committee recommend approval. The first amendment will prohibit<br />
a harvester from surrendering their license during the harvest year unless it is due to the<br />
harvester passing away or the harvester is a Military Reservist called to active duty. This will<br />
prevent a license holder from “selling” their license for pr<strong>of</strong>it to the next applicant on the priority<br />
list. This article was unanimously recommended by the Shellfish Commission and all the<br />
harvesters who were present at the Shellfish Conservation Commission Meeting on November<br />
29, <strong>2012</strong> and was confirmed again during a meeting on February 21st, 2013. The second part<br />
<strong>of</strong> the amendment was submitted by the Treasurer and will allow the <strong>Town</strong> to suspend a license<br />
if payment is not received within 30 days <strong>of</strong> an insufficient funds notice.)<br />
