any education provided by that community, whe<strong>the</strong>r or not that<br />

community is in receipt <strong>of</strong> any government subsidy, grant or o<strong>the</strong>r<br />

form <strong>of</strong> financial assistance designed to meet, in whole or in part,<br />

<strong>the</strong> cost <strong>of</strong> that education.<br />

(6) Nothing contained in or done under <strong>the</strong> authority <strong>of</strong><br />

any law shall be held to be inconsistent with or in contravention <strong>of</strong><br />

this section to <strong>the</strong> extent that <strong>the</strong> law in question makes provision<br />

(a) which is reasonably required in a democratic<br />

society<br />

(i) in <strong>the</strong> interests <strong>of</strong> defence, public<br />

safety, public order, public morality<br />

or public health; or<br />

(ii) for <strong>the</strong> purpose <strong>of</strong> protecting <strong>the</strong><br />

rights and freedoms <strong>of</strong> o<strong>the</strong>r persons,<br />

including <strong>the</strong> right to observe and<br />

practise any religion without <strong>the</strong><br />

unsolicited intervention <strong>of</strong> members<br />

(b)<br />

<strong>of</strong> any o<strong>the</strong>r religion; or<br />

with respect to standards or qualifications to<br />

be observed or met required in relation to<br />

places <strong>of</strong> education including any instruction<br />

(not being religious instruction) given at<br />

such places.<br />

(7) References in this section to a religion include<br />

references to a religious denomination, and cognate expressions<br />

having corresponding meanings.<br />

The right to freedom<br />

<strong>of</strong> thought and<br />

expression<br />

15.(1) Every person has <strong>the</strong> right to <strong>the</strong> freedom <strong>of</strong> thought<br />

and <strong>of</strong> expression; to form and hold his or her own opinions; to<br />

share those opinions with o<strong>the</strong>rs and to receive ideas and<br />

information and hear <strong>the</strong> opinions <strong>of</strong> o<strong>the</strong>rs, in private or through<br />

<strong>the</strong> Press and o<strong>the</strong>r forms <strong>of</strong> <strong>the</strong> public media; and, generally, to<br />

participate in whatever way in <strong>the</strong> public discourse which is<br />

essential to good democratic governance.<br />

(2) Parliament shall <strong>the</strong>refore make no law abridging or<br />

limiting <strong>the</strong> free exercise <strong>of</strong> <strong>the</strong> right <strong>of</strong> thought and <strong>of</strong> expression<br />

and <strong>of</strong> <strong>the</strong> Press, except where that law<br />

(a) is reasonably required in <strong>the</strong> interests <strong>of</strong><br />

defence, public safety, public order, public<br />

morality or public health;<br />

(b)<br />

is reasonably required for <strong>the</strong> purpose <strong>of</strong><br />

(i) protecting <strong>the</strong> reputations and rights<br />

<strong>of</strong> o<strong>the</strong>r persons or <strong>the</strong> private lives<br />

<strong>of</strong> persons concerned in legal<br />

proceedings;<br />

(ii) preventing <strong>the</strong> disclosure <strong>of</strong><br />

information received in confidence;<br />

(iii) maintaining <strong>the</strong> authority and<br />

independence <strong>of</strong> <strong>the</strong> courts;<br />
