(i) disputes between <strong>the</strong> Contracting<br />

Parties to <strong>the</strong> Agreement;<br />

(ii) disputes between any Contracting<br />

Parties to <strong>the</strong> Agreement and <strong>the</strong><br />

Community;<br />

(iii) referrals from national courts or<br />

tribunals <strong>of</strong> Contracting Parties to <strong>the</strong><br />

Agreement;<br />

(iv) applications by persons in<br />

accordance with <strong>the</strong> Caribbean Court<br />

<strong>of</strong> Justice Act, concerning <strong>the</strong><br />

interpretation and application <strong>of</strong> <strong>the</strong><br />

Treaty;<br />

(b) shall have exclusive jurisdiction<br />

(i) to deliver advisory opinions<br />

concerning <strong>the</strong> interpretation and<br />

application <strong>of</strong> <strong>the</strong> Treaty upon <strong>the</strong><br />

request <strong>of</strong> <strong>the</strong> Contracting Parties or<br />

<strong>the</strong> Community; and<br />

(ii) to decide whe<strong>the</strong>r <strong>the</strong> Court has<br />

jurisdiction in a matter before it,<br />

where <strong>the</strong>re is a dispute as to whe<strong>the</strong>r<br />

<strong>the</strong> Court has such jurisdiction.<br />

(3) Where a court or tribunal is seised <strong>of</strong> an issue whose<br />

resolution involves a question concerning <strong>the</strong> interpretation or<br />

application <strong>of</strong> <strong>the</strong> Treaty, that court or tribunal shall, if it considers<br />

that a decision on <strong>the</strong> question is necessary to enable it to deliver<br />

judgment, before delivering judgment refer <strong>the</strong> question to <strong>the</strong><br />

Court for determination.<br />

(4) The Court shall be a superior court <strong>of</strong> record and,<br />

save as o<strong>the</strong>rwise provided by Parliament, shall have all <strong>the</strong> powers<br />

<strong>of</strong> such a court.<br />

(5) A decision <strong>of</strong> <strong>the</strong> Court concerning Grenada shall be<br />

enforced in Grenada in like manner as if it were a decision <strong>of</strong> <strong>the</strong><br />

High Court or Court <strong>of</strong> Appeal.<br />

<strong>of</strong> Justice<br />

8 83. (i) The Judges <strong>of</strong> <strong>the</strong> Court shall be <strong>the</strong><br />

President and not more than 9 o<strong>the</strong>r Judges<br />

<strong>of</strong> whom at least 3 shall possess expertise in<br />

international law, including international<br />

trade law.<br />

(ii) The determination <strong>of</strong> any matter before <strong>the</strong><br />

Court shall be <strong>the</strong> concurrence <strong>of</strong> <strong>the</strong><br />

decisions <strong>of</strong> a majority <strong>of</strong> <strong>the</strong> Judges hearing<br />

<strong>the</strong> case.<br />

(iii) The Court may sit in such divisions as <strong>the</strong><br />

President directs, and a Judge may sit in<br />

every division.<br />
