187.(1) There shall be a Fire Service <strong>of</strong> Grenada.<br />

(2) Subject to this Constitution and any o<strong>the</strong>r law, <strong>the</strong><br />

Fire Service shall be organised and administered in such manner as<br />

may be provided for by or under an Act.<br />

(3) The Fire Service shall be commanded by a Chief<br />

Fire Officer who shall be appointed by <strong>the</strong> President by instrument<br />

under <strong>the</strong> Public Seal, on <strong>the</strong> recommendation <strong>of</strong> <strong>the</strong> Protective<br />

Services Commission, after <strong>the</strong> Commission has consulted with <strong>the</strong><br />

Prime Minister and <strong>the</strong> Leader <strong>of</strong> <strong>the</strong> Opposition. The Chief Fire<br />

Officer shall be responsible for <strong>the</strong> management and operations <strong>of</strong><br />

<strong>the</strong> Fire Service in accordance with law.<br />

(4) The President, acting on <strong>the</strong> advice <strong>of</strong> <strong>the</strong> Protective<br />

Services Commission, may, by instrument under <strong>the</strong> Public Seal,<br />

appoint a Deputy Chief Fire Officer and such o<strong>the</strong>r Fire Officers as<br />

may be deemed necessary to assist <strong>the</strong> Chief Fire Officer in <strong>the</strong><br />

efficient management and operation <strong>of</strong> <strong>the</strong> Fire Service.<br />

(5) The functions <strong>of</strong> <strong>the</strong> Fire Service are–<br />

(a) to assist in <strong>the</strong> maintenance <strong>of</strong> public order<br />

and security by protecting life and property<br />

against destruction by fire;<br />

(b) to assist in <strong>the</strong> fulfilment <strong>of</strong> <strong>the</strong> internal<br />

obligations <strong>of</strong> <strong>the</strong> State to provide for <strong>the</strong><br />

civil defence and security <strong>of</strong> all its citizens;<br />

(c) to provide assistance to civil authorities<br />

(d)<br />

during a period <strong>of</strong> emergency;<br />

to perform such o<strong>the</strong>r functions and services<br />

as may be prescribed by an Act; or as may<br />

be directed by <strong>the</strong> President for <strong>the</strong> common<br />

good and <strong>the</strong> security <strong>of</strong> <strong>the</strong> State.<br />

(6) The President, acting in accordance with <strong>the</strong> advice<br />

<strong>of</strong> <strong>the</strong> Protective Services Commission, may, by instrument under<br />

<strong>the</strong> Public Seal direct that, to such extent and subject to such<br />

conditions as may be specified in that instrument, <strong>the</strong> powers (o<strong>the</strong>r<br />

than <strong>the</strong> power to remove from <strong>of</strong>fice) vested in <strong>the</strong> President as<br />

Head <strong>of</strong> <strong>the</strong> Fire Service in relation to <strong>of</strong>fices in <strong>the</strong> Service shall<br />

(without prejudice to <strong>the</strong> exercise <strong>of</strong> those powers by <strong>the</strong> President<br />

as Head) be exercised by such one or more members <strong>of</strong> <strong>the</strong><br />

Protective Services Commission, or by such public <strong>of</strong>ficer, as may<br />

be specified.<br />

(7) Parliament may make provision with respect to<br />

<strong>of</strong>fences <strong>of</strong> indiscipline in <strong>the</strong> Fire Service and <strong>the</strong> punishment that<br />

may be imposed for any such <strong>of</strong>fence; and any power to exercise<br />

disciplinary control (including any power to remove a person from<br />

<strong>of</strong>fice) over persons holding or acting in any <strong>of</strong>fice in <strong>the</strong> Fire<br />

Service, being a power conferred by or under <strong>the</strong> provisions <strong>of</strong> this<br />

Chapter, shall be exercised in accordance with any such provision.<br />

(8) The Chief Fire Officer or Deputy Chief Fire Officer<br />

may be removed from <strong>of</strong>fice by <strong>the</strong> President if <strong>the</strong> Prime Minister<br />

represents to <strong>the</strong> satisfaction <strong>of</strong> <strong>the</strong> President that <strong>the</strong>re are credible<br />

grounds for his or her removal, and <strong>the</strong> President, acting on <strong>the</strong><br />
