(d) where the members of the National Assembly pass a resolution requiring the person to vacate the office; or (e) where that person is otherwise disqualified from being a member of the National Assembly in accordance with the Standing Orders established by the Assembly for disciplining the behaviour of its members. The office of Permanent Secretary The office of Cabinet Secretary The office of Attorney-General 53.(1) A department of government, subject to the general direction and control of the Minister charged with the responsibility therefor, shall be under the supervision of a public officer to be known as a Permanent Secretary. (2) Two or more government departments may be placed under the supervision of one Permanent Secretary. 54.(1) There shall be a Secretary to the Cabinet whose office shall be a public office. (2) The Cabinet Secretary shall have charge of the Cabinet Office, and shall be responsible, in accordance with instructions given by the Prime Minister, (a) for arranging the business for meetings and keeping the minutes of the meetings of the (b) Cabinet; for conveying the decisions of the Cabinet to the appropriate persons or authority; and shall have such other functions as the Prime Minister may direct. 55.(1) There shall be an Attorney-General whose office shall be a public office. (2) The Attorney-General shall be appointed by the President, acting on the advice of the Prime Minister. (3) The Attorney-General shall be the principal legal adviser to the Government and may (a) institute or undertake criminal proceedings against any person before any court, other than a court-martial, in respect of any offence alleged to have been committed by that person; (b) take over and continue any such criminal proceedings that have been instituted or undertaken by any person or authority; and (c) discontinue at any stage before judgment is delivered any such criminal proceedings instituted or undertaken by himself or herself or any other person or authority. (4) The powers of the Attorney-General under subsection (3) of this section may be exercised in person or through 44
other persons acting under and in accordance with the general or special instructions of the Attorney-General. (5) For the purpose of this section, an appeal from a judgment in criminal proceedings before any court or any case stated or question of law reserved for the purpose of any other court, shall be deemed to be part of the court proceedings. (6) The authority conferred on the Attorney-General under this section shall not be exercised in relation to an appeal by a person convicted in any criminal proceedings or to any case stated or question of law reserved at the instance of that person. 45
