acting under and in accordance with his or her general or special<br />

instructions.<br />

(3) The powers conferred upon <strong>the</strong> Director <strong>of</strong> Public<br />

Prosecutions are vested in him or her to <strong>the</strong> exclusion <strong>of</strong> any o<strong>the</strong>r<br />

person or authority.<br />

(4) Where a person or authority o<strong>the</strong>r than <strong>the</strong> Director<br />

<strong>of</strong> Public Prosecutions has instituted criminal proceedings, those<br />

proceedings may be withdrawn by or at <strong>the</strong> instance <strong>of</strong> that person<br />

or authority with <strong>the</strong> leave <strong>of</strong> <strong>the</strong> court.<br />

(5) The Director <strong>of</strong> Public Prosecutions is not subject to<br />

<strong>the</strong> direction or control <strong>of</strong> any o<strong>the</strong>r person or authority in <strong>the</strong><br />

exercise <strong>of</strong> <strong>the</strong> powers conferred on him or her by this section.<br />

(6) For <strong>the</strong> purposes <strong>of</strong> this section,<br />

(a) an appeal from a determination in any<br />

(b)<br />

criminal proceedings before a court; or<br />

a case stated or question <strong>of</strong> law reserved, for<br />

<strong>the</strong> purposes <strong>of</strong> any such proceedings, to<br />

ano<strong>the</strong>r court is to be taken to be part <strong>of</strong><br />

those proceedings.<br />

(7) The Director <strong>of</strong> Public Prosecutions shall, before<br />

entering upon <strong>the</strong> duties <strong>of</strong> <strong>the</strong> <strong>of</strong>fice, take and subscribe before <strong>the</strong><br />

President <strong>the</strong> Oath <strong>of</strong> Allegiance and <strong>the</strong> Oath for <strong>the</strong> due<br />

execution <strong>of</strong> <strong>the</strong> <strong>of</strong>fice prescribed in this Constitution.<br />

172.(1) The Attorney-General may, in <strong>the</strong> case <strong>of</strong> any<br />

<strong>of</strong>fence to which this section applies, give general or special<br />

directions to <strong>the</strong> Director <strong>of</strong> Public Prosecutions as to <strong>the</strong> exercise<br />

<strong>of</strong> <strong>the</strong> powers conferred upon <strong>the</strong> Director, and <strong>the</strong> Director shall<br />

act in accordance with those directions.<br />

(2) This section applies to any <strong>of</strong>fence<br />

(a) relating to<br />

(i) piracy;<br />

(ii) trading or o<strong>the</strong>rwise dealing in<br />

slaves;<br />

(b)<br />

(c)<br />

(iii)<br />

(iv)<br />

foreign enlistment;<br />

publications calculated to interfere<br />

with <strong>the</strong> peaceful relations <strong>of</strong> <strong>the</strong><br />

Commonwealth <strong>of</strong> Grenada with<br />

foreign states;<br />

(v) high treason, treason, misprison <strong>of</strong><br />

treason or treachery;<br />

(vi) sedition or seditious meetings;<br />

(vii) <strong>of</strong>ficial secrets;<br />

(viii) mutiny or incitement to mutiny;<br />

(ix) unlawful oaths;<br />

under or enactment relating to any right or<br />

obligation <strong>of</strong> <strong>the</strong> Commonwealth <strong>of</strong> Grenada<br />

under international law; or<br />

which in <strong>the</strong> opinion <strong>of</strong> <strong>the</strong> Attorney-General<br />

concerns <strong>the</strong> security <strong>of</strong> <strong>the</strong> State.<br />
