84. (i) The President <strong>of</strong> <strong>the</strong> Court shall be<br />

appointed by <strong>the</strong> [qualified majority] vote <strong>of</strong> three-quarters <strong>of</strong> <strong>the</strong><br />

Contracting Parties to <strong>the</strong> Agreement on <strong>the</strong> recommendation <strong>of</strong><br />

<strong>the</strong> Regional Judicial and Legal Services Commission.<br />

(ii) A Judge <strong>of</strong> <strong>the</strong> Court o<strong>the</strong>r than <strong>the</strong> President<br />

shall be appointed by <strong>the</strong> majority vote <strong>of</strong> all<br />

<strong>the</strong> members <strong>of</strong> <strong>the</strong> Regional Judicial and<br />

Legal Services Commission.<br />

(iii) The qualification for appointment <strong>of</strong> <strong>the</strong><br />

President and a Judge shall be prescribed by<br />

law.<br />

(iv) A Judge <strong>of</strong> <strong>the</strong> Court shall not enter upon <strong>the</strong><br />

duties <strong>of</strong> his or her <strong>of</strong>fice until he or she has<br />

taken and subscribed <strong>the</strong> judicial oath in <strong>the</strong><br />

form set out in <strong>the</strong> First Schedule.<br />

Tenure <strong>of</strong> <strong>of</strong>fice <strong>of</strong> <strong>the</strong><br />

President and Judges<br />

<strong>of</strong> <strong>the</strong> Court<br />

85. (a) The President <strong>of</strong> <strong>the</strong> Court shall hold <strong>of</strong>fice<br />

for<br />

(i) a term <strong>of</strong> 7 years; or<br />

(ii) until he or she attains <strong>the</strong> age <strong>of</strong> 72<br />

years or sooner resigns or retires,<br />

whichever is <strong>the</strong> earlier.<br />

(b) A Judge <strong>of</strong> <strong>the</strong> Court shall hold <strong>of</strong>fice until<br />

he or she attains <strong>the</strong> age <strong>of</strong> 72 years or<br />

sooner resigns or retires.<br />

(c) Notwithstanding that<br />

(i) he or she has attained <strong>the</strong> age at<br />

which he or she is required by <strong>the</strong><br />

provisions <strong>of</strong> this section to vacate<br />

his or her <strong>of</strong>fice; or<br />

(ii) he or she has retired or resigned<br />

before reaching such age, <strong>the</strong><br />

President or o<strong>the</strong>r Judge <strong>of</strong> <strong>the</strong> Court<br />

may sit as a Judge for <strong>the</strong> purpose <strong>of</strong><br />

delivering judgment or discharging<br />

any o<strong>the</strong>r duties in relation to<br />

proceedings which were commenced<br />

before him or her before he or she<br />

has attained that age or, as <strong>the</strong> case<br />

may be, has retired or resigned.<br />

THE SUPREME COURT<br />

86. There shall be a Supreme Court for <strong>the</strong><br />

Commonwealth <strong>of</strong> Grenada which shall be styled <strong>the</strong> Eastern<br />

Caribbean Supreme Court and shall be a superior court <strong>of</strong> record.<br />

87.(1) The Supreme Court shall consist <strong>of</strong> a Court <strong>of</strong><br />

Appeal and a High Court <strong>of</strong> Justice, and shall have such<br />
