for <strong>the</strong> purpose <strong>of</strong> preventing imminent<br />

danger to public safety and order;<br />

for <strong>the</strong> purpose <strong>of</strong> combatting <strong>the</strong> danger <strong>of</strong><br />

epidemics;<br />

for <strong>the</strong> purpose <strong>of</strong> protecting endangered<br />

minors;<br />

for <strong>the</strong> purpose <strong>of</strong> enforcing <strong>the</strong> judgment or<br />

order <strong>of</strong> a court in any proceedings;<br />

for <strong>the</strong> purpose <strong>of</strong> protecting <strong>the</strong> rights <strong>of</strong><br />

o<strong>the</strong>r persons; or<br />

for <strong>the</strong> purpose <strong>of</strong> authorising an <strong>of</strong>ficer or<br />

agent <strong>of</strong> <strong>the</strong> Government, or <strong>of</strong> a local<br />

government authority or <strong>of</strong> a body corporate<br />

established directly by law for public<br />

purposes, to enter on <strong>the</strong> premises <strong>of</strong> any<br />

person in order to<br />

inspect those premises or anything on those<br />

premises for <strong>the</strong> purposes <strong>of</strong> any tax, duty,<br />

rate, cess or impost, or for <strong>the</strong> purpose <strong>of</strong><br />

determining whe<strong>the</strong>r any law has been<br />

complied with; or<br />

carry out work connected with any property<br />

that is lawfully on those premises and that<br />

belongs to <strong>the</strong> Government or that authority<br />

or body corporate, as <strong>the</strong> case may be.<br />

The right to <strong>the</strong> use<br />

and enjoyment <strong>of</strong><br />

property<br />

13.(1) Every person has <strong>the</strong> right to <strong>the</strong> use and enjoyment<br />

<strong>of</strong> his or her property.<br />

(2) A person’s property shall not be compulsorily<br />

acquired except only in <strong>the</strong> public interest or for an express public<br />

purpose, and under <strong>the</strong> authority <strong>of</strong> a written law which<br />

(a) describes <strong>the</strong> nature and extent <strong>of</strong> <strong>the</strong><br />

(b)<br />

property to be taken;<br />

states <strong>the</strong> principles on which and <strong>the</strong><br />

manner in which compensation for <strong>the</strong><br />

taking is to be determined and given; and<br />

(c) gives to any person claiming such<br />

compensation a right <strong>of</strong> access, ei<strong>the</strong>r<br />

directly or by way <strong>of</strong> appeal, to a court <strong>of</strong><br />

competent jurisdiction for <strong>the</strong> determination<br />

<strong>of</strong> his or her interest in <strong>the</strong> property and <strong>the</strong><br />

amount <strong>of</strong> his or her compensation.<br />

(3) Nothing contained in or done under <strong>the</strong> authority <strong>of</strong><br />

any law shall be held to be inconsistent with or in contravention <strong>of</strong><br />

this section to <strong>the</strong> extent that <strong>the</strong> law in question makes provision<br />

for<br />

(a)<br />

<strong>the</strong> taking <strong>of</strong> any property<br />

(i)<br />

in satisfaction <strong>of</strong> any tax, duty, rate,<br />

cess or o<strong>the</strong>r impost;<br />
