to discriminate against a person is unfair<br />

unless it is proved, or a law provides, that<br />

<strong>the</strong> discrimination is justifiable.<br />

The right to vote and to<br />

stand for public <strong>of</strong>fice<br />

19.(1) Every Citizen <strong>of</strong> Grenada eighteen years <strong>of</strong> age or<br />

over has <strong>the</strong> right<br />

(a) to take part in <strong>the</strong> public affairs <strong>of</strong> <strong>the</strong> State<br />

ei<strong>the</strong>r directly or through freely chosen<br />

representatives;<br />

(b) to be registered as a voter for <strong>the</strong> purpose <strong>of</strong><br />

and to vote by secret ballot at public<br />

elections, which shall be by universal and<br />

equal suffrage, for <strong>the</strong> government <strong>of</strong> his or<br />

her choice; or<br />

(c) to stand for, and, if elected, to hold elective<br />

public <strong>of</strong>fice.<br />

(2) Nothing contained in or done under <strong>the</strong> authority <strong>of</strong><br />

a law shall be held to be inconsistent with or in contravention <strong>of</strong><br />

subsection (1) to <strong>the</strong> extent that <strong>the</strong> law in question authorises<br />

limitations on <strong>the</strong> right described in that subsection that are<br />

reasonably justifiable in a democratic society.<br />

PART II<br />

Emergency Provisions<br />

Public emergency<br />

20.(1) The President may at any time by proclamation (a<br />

“proclamation <strong>of</strong> emergency”) declare that a period <strong>of</strong> public<br />

emergency exists.<br />

(2) A proclamation <strong>of</strong> emergency does not have effect<br />

unless it states that <strong>the</strong> President is satisfied that a public<br />

emergency has arisen<br />

as a result <strong>of</strong> a state <strong>of</strong> war, or <strong>the</strong><br />

imminence <strong>of</strong> a state <strong>of</strong> war, between<br />

Grenada and a foreign State;<br />

as a result <strong>of</strong> <strong>the</strong> occurrence <strong>of</strong> an<br />

earthquake, hurricane, flood or fire, or <strong>the</strong><br />

outbreak <strong>of</strong> pestilence or infectious disease,<br />

or some o<strong>the</strong>r calamity whe<strong>the</strong>r similar to<br />

<strong>the</strong> foregoing or not; or<br />

by reason that action has been taken, or is<br />

immediately threatened, by some person or<br />

persons, <strong>of</strong> such a nature and on so extensive<br />

a scale as to be likely to<br />

(i) endanger <strong>the</strong> public safety; or<br />

(ii) deprive <strong>the</strong> community or a<br />

substantial portion <strong>of</strong> <strong>the</strong> community<br />

<strong>of</strong> supplies or services essential to<br />

life.<br />
