CHAPTER XV<br />

ALTERATION OF THE CONSTITUTION<br />

Alteration <strong>of</strong> Constitution 189.(1) Subject to this section, this Constitution may be<br />

altered or amended –<br />

(a) by a Bill stating in <strong>the</strong> long title that it is a<br />

Bill to alter or amend this Constitution, and<br />

is passed by a vote <strong>of</strong> not less than twothirds<br />

<strong>of</strong> <strong>the</strong> members <strong>of</strong> <strong>the</strong> National<br />

Assembly;<br />

(b) <strong>the</strong>re has been an interval <strong>of</strong> not less than<br />

ninety days between <strong>the</strong> introduction <strong>of</strong> <strong>the</strong><br />

Bill in <strong>the</strong> National Assembly and <strong>the</strong><br />

beginning <strong>of</strong> <strong>the</strong> proceedings in <strong>the</strong><br />

Assembly on <strong>the</strong> final reading <strong>of</strong> <strong>the</strong> Bill in<br />

that House;<br />

(c) <strong>the</strong> Bill has been approved on a referendum,<br />

held in accordance with such provision as<br />

may be made in that behalf by Parliament,<br />

by not less than two-thirds <strong>of</strong> all <strong>the</strong> votes<br />

validly cast on that referendum; and<br />

(d) <strong>the</strong> Speaker certifies that <strong>the</strong> conditions<br />

stated in this section have been satisfied.<br />

(2) Every person who, at <strong>the</strong> time when <strong>the</strong> referendum<br />

is held, would be entitled to vote in elections <strong>of</strong> members <strong>of</strong> <strong>the</strong><br />

National Assembly shall be entitled to vote on a referendum held<br />

for <strong>the</strong> purposes <strong>of</strong> this section in accordance with such procedures<br />

as may be prescribed by Parliament for <strong>the</strong> purposes <strong>of</strong> <strong>the</strong><br />

referendum and no o<strong>the</strong>r person shall be entitled so to vote.<br />

(3) The conduct <strong>of</strong> any referendum for <strong>the</strong> purposes <strong>of</strong><br />

subsection (2) <strong>of</strong> this section shall be under <strong>the</strong> general supervision<br />

<strong>of</strong> <strong>the</strong> Supervisor <strong>of</strong> Elections and <strong>the</strong> provisions <strong>of</strong> Chapter VI <strong>of</strong><br />

this Constitution pertaining to <strong>the</strong> exercise by <strong>the</strong> Supervisor <strong>of</strong><br />

Elections or by any o<strong>the</strong>r <strong>of</strong>ficer <strong>of</strong> those functions, relating to<br />

elections <strong>of</strong> members <strong>of</strong> <strong>the</strong> National Assembly shall likewise<br />

apply with respect to a referendum.<br />

(4) (a) A Bill to alter this Constitution shall not be<br />

submitted to <strong>the</strong> President for his or her<br />

assent unless it is accompanied by a<br />

certificate under <strong>the</strong> hand <strong>of</strong> <strong>the</strong> Speaker <strong>of</strong><br />

<strong>the</strong> National Assembly (or, if <strong>the</strong> Speaker is<br />

for any reason unable to exercise <strong>the</strong><br />

functions <strong>of</strong> his or her <strong>of</strong>fice, <strong>the</strong> Deputy<br />

Speaker) that <strong>the</strong> relevant provisions <strong>of</strong> this<br />

section have been complied with and, where<br />

a referendum has been held, by a certificate<br />

<strong>of</strong> <strong>the</strong> Supervisor <strong>of</strong> Elections stating <strong>the</strong><br />

results <strong>of</strong> <strong>the</strong> referendum.<br />

(b) The certificate <strong>of</strong> <strong>the</strong> Speaker or, as <strong>the</strong> case<br />

may be, <strong>the</strong> Deputy Speaker under this<br />
