(e) he or she shall be afforded reasonable<br />

facilities to consult and instruct an attorneyat-law<br />

at his or her own expense; and he or<br />

she and that attorney-at-law shall be<br />

permitted to make written or oral<br />

representations or both to <strong>the</strong> tribunal<br />

appointed for <strong>the</strong> review <strong>of</strong> <strong>the</strong> case.<br />

(5) On review by a tribunal pursuant to subsection (4)<br />

<strong>of</strong> <strong>the</strong> case <strong>of</strong> a person whose freedom <strong>of</strong> movement has been<br />

restricted, <strong>the</strong> tribunal may make to <strong>the</strong> authority by whom <strong>the</strong><br />

restrictions were ordered recommendations concerning <strong>the</strong><br />

necessity or expediency <strong>of</strong> continuing restrictions; but, unless it is<br />

o<strong>the</strong>rwise provided by law, that authority is not obliged to act in<br />

accordance with those recommendations.<br />

The right not to be<br />

discriminated<br />

against<br />

18.(1) Subject to <strong>the</strong> provisions in this section,<br />

(a) no law shall make any provision that is<br />

discriminatory ei<strong>the</strong>r <strong>of</strong> itself or in its effect;<br />

and<br />

(b) no person shall be treated in a discriminatory<br />

manner by any person acting by virtue <strong>of</strong><br />

any written law or in <strong>the</strong> performance <strong>of</strong> <strong>the</strong><br />

functions <strong>of</strong> any public <strong>of</strong>fice or any public<br />

authority.<br />

(2) In this section, <strong>the</strong> expression “discriminatory”<br />

means affording different treatment to different persons attributable<br />

wholly or mainly to <strong>the</strong>ir respective descriptions by race, place <strong>of</strong><br />

origin, political opinion, colour, creed or sex, whereby persons <strong>of</strong><br />

one such description<br />

(a)<br />

or<br />

(b)<br />

are subject to disabilities not made subject;<br />

are accorded privileges or advantages which<br />

are not afforded to persons <strong>of</strong> ano<strong>the</strong>r such<br />

description.<br />

(3) Subsection (1)(a) does not apply to any law so far as<br />

that law makes provision<br />

(a) with respect to persons who are not Citizens;<br />

(b) with respect to adoption, marriage, divorce,<br />

burial, devolution <strong>of</strong> property on death or<br />

o<strong>the</strong>r matters <strong>of</strong> personal law;<br />

(c)<br />

whereby persons <strong>of</strong> any such description as<br />

is mentioned in subsection (2) may be<br />

subjected to any disability or restriction or<br />

may be accorded any privilege or advantage<br />

which, having regard to its nature and to<br />

special circumstances pertaining to those<br />

persons or to persons <strong>of</strong> any o<strong>the</strong>r such<br />

description, is reasonably justifiable in a<br />

democratic society;<br />
