under that section is <strong>the</strong> Prime Minister, acting after consultation<br />

with <strong>the</strong> Leader <strong>of</strong> <strong>the</strong> Opposition.<br />

(8) At any meeting <strong>of</strong> <strong>the</strong> Commission, a quorum is<br />

constituted if three members are present; and, if a quorum is<br />

constituted, <strong>the</strong> Commission is not disqualified for <strong>the</strong> transaction<br />

<strong>of</strong> business by reason <strong>of</strong> any vacancy among <strong>the</strong> Commission’s<br />

members or <strong>the</strong> absence <strong>of</strong> any member.<br />

(9) The fact that some person took part in proceedings<br />

<strong>of</strong> <strong>the</strong> Commission who was not entitled to do so does not<br />

invalidate those proceedings.<br />

(10) Any question proposed for decision at a meeting <strong>of</strong><br />

<strong>the</strong> Commission is determined by a majority <strong>of</strong> <strong>the</strong> votes <strong>of</strong> <strong>the</strong><br />

members <strong>of</strong> <strong>the</strong> Commission present and voting, and if on any such<br />

question <strong>the</strong> votes are equally divided, <strong>the</strong> member presiding has<br />

and shall exercise a casting vote.<br />

(11) Subject to <strong>the</strong> provisions <strong>of</strong> this section, <strong>the</strong><br />

Commission may regulate its own procedure.<br />

Functions <strong>of</strong><br />

<strong>the</strong> Commission<br />

75.(1) The Commission shall be provided with an <strong>of</strong>fice,<br />

and with staff and administrative facilities, appropriate to <strong>the</strong><br />

Commission’s responsibilities.<br />

(2) The salaries and allowances <strong>of</strong> <strong>the</strong> staff <strong>of</strong> <strong>the</strong><br />

Commission are charged on and shall be paid out <strong>of</strong> <strong>the</strong><br />

Consolidated Fund.<br />

(3) Notwithstanding subsections (1) and (2), <strong>the</strong><br />

President, acting in accordance with <strong>the</strong> advice <strong>of</strong> <strong>the</strong> Commission<br />

but subject to <strong>the</strong> consent <strong>of</strong> <strong>the</strong> Prime Minister, may confer<br />

powers and impose duties on any public <strong>of</strong>ficer or any authority <strong>of</strong><br />

<strong>the</strong> Government for <strong>the</strong> purpose <strong>of</strong> <strong>the</strong> discharge <strong>of</strong> any <strong>of</strong> <strong>the</strong><br />

Commission’s functions.<br />

76.(1) The registration <strong>of</strong> voters and <strong>the</strong> conduct <strong>of</strong><br />

elections <strong>of</strong> members <strong>of</strong> <strong>the</strong> National Assembly in every<br />

constituency, and any matters that appear to <strong>the</strong> Commission to be<br />

incidental to or consequential upon ei<strong>the</strong>r <strong>of</strong> those functions, are<br />

subject to <strong>the</strong> direction and supervision <strong>of</strong> <strong>the</strong> Commission.<br />

(2) The law providing for <strong>the</strong> election <strong>of</strong> members <strong>of</strong><br />

<strong>the</strong> National Assembly shall in particular contain provisions<br />

(a) for <strong>the</strong> division <strong>of</strong> Grenada into<br />

constituencies pursuant to reviews made by<br />

<strong>the</strong> Commission under section 69;<br />

(b) for <strong>the</strong> conduct <strong>of</strong> such elections, and for<br />

ensuring that as far as practicable any person<br />

qualified to vote at such an election has a<br />

reasonable opportunity <strong>of</strong> voting;<br />

(c) relating to <strong>the</strong> identification <strong>of</strong> electors, and<br />

for ensuring that as far as practicable a<br />

person shall not vote at such an election<br />

(i) who is not entitled to vote;<br />

(ii) when he or she is not entitled to vote;<br />
