Chapter shall be made in writing and shall state <strong>the</strong> choice <strong>of</strong> <strong>the</strong><br />

<strong>of</strong>ficer whe<strong>the</strong>r <strong>the</strong> case should be reviewed by<br />

(i) a Court <strong>of</strong> Law; or<br />

(ii) <strong>the</strong> Public Service Appeal Board on appeal;<br />

and once <strong>the</strong> <strong>of</strong>ficer’s choice <strong>of</strong> one <strong>of</strong> those forms<br />

<strong>of</strong> review has been so made, <strong>the</strong> o<strong>the</strong>r form <strong>of</strong><br />

review is <strong>the</strong>refore not available to him or her in that<br />

case.<br />

(11) Where a case has been referred to a Court <strong>of</strong> Law or<br />

to <strong>the</strong> Public Service Appeal Board, as <strong>the</strong> case may be, <strong>the</strong> Court<br />

or <strong>the</strong> Board shall consider <strong>the</strong> case and,<br />

(a) where <strong>the</strong> case is dealt with by a Court, that<br />

Court shall advise <strong>the</strong> President; and<br />

(b) where <strong>the</strong> case is dealt with by <strong>the</strong> Board,<br />

<strong>the</strong> Board shall render its decision to <strong>the</strong><br />

Protective Services Commission, which shall<br />

<strong>the</strong>n advise <strong>the</strong> President in conformity with<br />

<strong>the</strong> decision <strong>of</strong> <strong>the</strong> Board,<br />

what action should be taken in respect <strong>of</strong> <strong>the</strong> <strong>of</strong>ficer, and <strong>the</strong><br />

President shall act in accordance with that advice.<br />

(12) Subject to <strong>the</strong> provisions <strong>of</strong> this Chapter, <strong>the</strong> power<br />

to appoint persons to hold or act in <strong>of</strong>fices in <strong>the</strong> Police Force<br />

below <strong>the</strong> rank <strong>of</strong> Inspector <strong>of</strong> Police (i.e. at <strong>the</strong> rank <strong>of</strong> Sergeant<br />

and below, and including <strong>the</strong> power to confirm such appointments),<br />

<strong>the</strong> power to exercise disciplinary control over persons holding or<br />

acting in such <strong>of</strong>fices and <strong>the</strong> power to remove such persons from<br />

<strong>of</strong>fice shall vest in <strong>the</strong> Protective Services Commission.<br />

(13) Nothing in this section shall be construed as<br />

precluding <strong>the</strong> assignment to a Ministry <strong>of</strong> Government <strong>the</strong><br />

responsibility for <strong>the</strong> organisation, maintenance and administration<br />

<strong>of</strong> <strong>the</strong> Police Force.<br />

PART III<br />

THE PRISON SERVICE<br />

The Prison Service<br />

186.(1) There shall be a Prison Service <strong>of</strong> Grenada.<br />

(2) Subject to this Constitution and any o<strong>the</strong>r law, <strong>the</strong><br />

Prison Service shall be organised and administered in such manner<br />

as may be provided for by or under an Act.<br />

(3) The Prison Service shall be commanded by a<br />

Commissioner <strong>of</strong> Prisons who shall be appointed by <strong>the</strong> President<br />

by instrument under <strong>the</strong> Public Seal, on <strong>the</strong> recommendation <strong>of</strong> <strong>the</strong><br />

Protective Services Commission, after <strong>the</strong> Commission has<br />

consulted with <strong>the</strong> Prime Minister and <strong>the</strong> Leader <strong>of</strong> <strong>the</strong><br />

Opposition. The Commissioner <strong>of</strong> Prisons shall be responsible for<br />

<strong>the</strong> management and operations <strong>of</strong> <strong>the</strong> Prison Service in accordance<br />

with law.<br />

(4) The President, acting on <strong>the</strong> advice <strong>of</strong> <strong>the</strong> Protective<br />

Services Commission, may, by instrument under <strong>the</strong> Public Seal,<br />

appoint a Deputy Commissioner <strong>of</strong> Prisons and Inspectors <strong>of</strong><br />
