THE EXECUTIVE<br />

Swearing in <strong>of</strong> Prime<br />

Tenure <strong>of</strong> <strong>of</strong>fice <strong>of</strong><br />

Prime Minister<br />

47.(1) The executive authority <strong>of</strong> <strong>the</strong> Commonwealth <strong>of</strong><br />

Grenada shall vest in a Cabinet consisting <strong>of</strong> a Prime Minister and<br />

such o<strong>the</strong>r Ministers as may be reasonably required for <strong>the</strong> good<br />

governance <strong>of</strong> <strong>the</strong> society and shall be exercised in accordance with<br />

this Constitution and <strong>the</strong> laws <strong>of</strong> Grenada.<br />

(2) The Prime Minister shall be a person directly<br />

elected to <strong>the</strong> National Assembly in a general election and shall be<br />

<strong>the</strong> leader <strong>of</strong> <strong>the</strong> political party with <strong>the</strong> majority <strong>of</strong> seats in <strong>the</strong><br />

National Assembly, or <strong>the</strong> person, also directly elected in a general<br />

election, who, in <strong>the</strong> judgment <strong>of</strong> <strong>the</strong> President, commands <strong>the</strong><br />

support <strong>of</strong> <strong>the</strong> largest number <strong>of</strong> <strong>the</strong> members <strong>of</strong> <strong>the</strong> National<br />

Assembly.<br />

(3) The Prime Minister may appoint a Deputy Prime<br />

Minister who shall serve as Prime Minister during <strong>the</strong> absence <strong>of</strong><br />

<strong>the</strong> Prime Minister from <strong>the</strong> Commonwealth, or in <strong>the</strong> event <strong>of</strong> <strong>the</strong><br />

Prime Minister’s death or illness.<br />

(4) If, however, in <strong>the</strong> event <strong>of</strong> <strong>the</strong> Prime Minister’s<br />

incapacity <strong>the</strong> Deputy is also unable to assume <strong>the</strong> Office <strong>of</strong> Prime<br />

Minister, <strong>the</strong> President shall, with or without any consultation,<br />

name a Minister to act as Prime Minister.<br />

(5) The Cabinet shall be responsible for <strong>the</strong><br />

maintenance <strong>of</strong> peace, order, good government, <strong>the</strong> security <strong>of</strong> <strong>the</strong><br />

Commonwealth, <strong>the</strong> execution and maintenance <strong>of</strong> this<br />

Constitution and <strong>the</strong> laws <strong>of</strong> Grenada and <strong>of</strong> all social services, and<br />

such o<strong>the</strong>r functions as are necessary for <strong>the</strong> promotion <strong>of</strong> <strong>the</strong><br />

common good and <strong>the</strong> general welfare <strong>of</strong> all <strong>the</strong> People <strong>of</strong> <strong>the</strong><br />

Commonwealth <strong>of</strong> Grenada.<br />

48. The Prime Minister and all Ministers <strong>of</strong><br />

Government shall be sworn into <strong>of</strong>fice by <strong>the</strong> President <strong>of</strong> <strong>the</strong><br />

Commonwealth <strong>of</strong> Grenada; where upon, <strong>the</strong>y shall each take and<br />

subscribe <strong>the</strong> Oath <strong>of</strong> Allegiance and <strong>the</strong> Oath <strong>of</strong> Office.<br />

49.(1) The Prime Minister and <strong>the</strong> Cabinet shall hold <strong>of</strong>fice<br />

for a term <strong>of</strong> five years at <strong>the</strong> end <strong>of</strong> which term, <strong>the</strong> National<br />

Assembly shall be dissolved by <strong>the</strong> President.<br />

(2) If, however, prior to <strong>the</strong> expiration <strong>of</strong> <strong>the</strong> five-year<br />

term, a resolution <strong>of</strong> no confidence in <strong>the</strong> Government is passed by<br />

a majority <strong>of</strong> all <strong>the</strong> members <strong>of</strong> <strong>the</strong> National Assembly and <strong>the</strong><br />

Prime Minister does not within three days tender <strong>the</strong> resignation <strong>of</strong><br />

<strong>the</strong> Government from <strong>of</strong>fice or advise <strong>the</strong> President to dissolve <strong>the</strong><br />

Parliament, <strong>the</strong> President shall, with or without any consultation,<br />

dissolve <strong>the</strong> Parliament.<br />

(3) The <strong>of</strong>fice <strong>of</strong> a Minister, o<strong>the</strong>r than <strong>the</strong> Prime<br />

Minister, shall become vacant, prior to <strong>the</strong> expiration <strong>of</strong> <strong>the</strong> fiveyear<br />

term,<br />
